试论治安管理的基本属性

【摘要】：治安管理具有秩序模糊性、价值辩证性、管理局限性以及规范多样性等基本属性。治安管理主、客体对治安秩序的认识差异导致从有序到无序的转折点难以把握,通过维护秩序进而保障自由的辩证关系不易察觉,治安秩序维护仅限于恢复原有秩序而无法解决问题根源,治安管理规范和手段不局限于法律。应在政策制定和实践层面遵循适度控制的治安管理策略,更加关注治安管理客体的发展变化,明确治安秩序维护职能,深刻认知治安管理价值,合理制定治安管理规范,灵活运用治安管理手段,实现治安管理体系和治理能力现代化。
[Abstract]:Public security management has some basic attributes, such as order fuzziness, value dialectics, management limitation and normative diversity. The difference of the object's understanding of the public order leads to the difficulty of grasping the turning point from order to disorder, and the dialectical relation of safeguarding order and safeguarding freedom is difficult to detect. The maintenance of public security order is limited to restoring the original order but can not solve the root cause of the problem. The standard and means of public security management are not limited to the law, but should follow the moderately controlled public security management strategy at the level of policy formulation and practice. We should pay more attention to the development and change of the object of public security management, make clear the function of maintaining public order, deeply understand the value of public security management, rationally formulate the standard of public security management, and use flexibly the means of public security management. Realize the modernization of public security management system and management ability.
