偷渡犯罪的成因及对策研究

【摘要】：近年来,我国经济迅猛发展,综合国力不断增强,偷渡犯罪有了新的发展趋势,我国开始慢慢退出偷渡出境国的历史,逐渐向过境国、中转国和目的国转化。据笔者多年在实务工作中积累的资料来看,我国偷渡犯罪在犯罪趋势、犯罪方法、犯罪人员主体都有了新的特点,产生了新的问题,需要我们对我国偷渡犯罪的现状做一个系统的梳理。笔者立足于犯罪学的实证分析,发现这些问题的出现是经济、法制、社会制度等因素综合作用的结果。针对其治理也必须在我们对国内形势有充分的把握的前提下,重拳出击,对症下药,从法制建设层面、制度设计层面以及国际合作等方面综合入手,以解决当前面临的实际问题。

According to the data accumulated by the author in practice for many years, the crime of smuggling in our country has new characteristics and new problems in crime trend, crime method and criminal subject. The author based on the empirical analysis of criminology, found that the emergence of these problems is the economy, the legal system. As a result of the comprehensive action of social system and other factors. In view of its governance, we must also have a full grasp of the domestic situation under the premise of a heavy fist attack, the right medicine, from the legal construction level. The system design and international cooperation are integrated to solve the current practical problems.
