家庭暴力引发女性暴力犯罪的预防对策研究

【摘要】：女性犯罪历来是犯罪学理论研究的薄弱环节，但是随着现代社会复杂化的发展，女性犯罪已经成为影响社会和谐与稳定的一个重要因素。基于此，在学术研究上我们也有必要把女性犯罪放在一个新的视角和高度来重新审视。该篇文章的写作即是着眼于由家庭暴力所引发的女性暴力犯罪这一特定层面，将家庭暴力与女性暴力犯罪放在一个因果的链条中进行分析。换言之，文章的着力点就是从包含多层面意义的家庭暴力中剖检出了夫妻关系中丈夫对妻子的暴力形式，以及从越来越多元复杂的女性犯罪现象中单列出了由家庭暴力作为导火索而引发的女性暴力犯罪这一类型，进而将二者结合起来进行分析，并在此基础上从立法的角度提出女性暴力犯罪的预防对策，从而更好地保护家庭内女性的合法权益。文章写作的第一部分首先通过家庭暴力来引出全文论述的基础，即家庭暴力是引发女性暴力犯罪的重要诱因。在这个层面下，分别分析了我国的家庭暴力现象以及女性以暴制暴犯罪的形成过程，指出在当前社会生活中存在的现实问题及其危害性。第二部分先是对我国现有的家庭暴力法律政策进行了一个宏观的总结分析，目的是通过对这些法律政策的梳理和审视，发现并进一步提出当前立法上对家庭暴力规制所存在的缺陷和漏洞。经过前两部分的论述和分析，第三部分着力从立法的层面以及从法律保护的角度来探讨家庭暴力引发女性暴力犯罪的预防对策，这其中包括统一的反家庭暴力法的制定、民事保护令的实施以及引入受虐妇女综合症专家证人制度使之成为法定量刑情节的建议。女性暴力犯罪成为一个不可忽视的社会现象，在司法个案中越来越表现出其区别于男性犯罪独有的心理特点和诱发因素，，文章在写作中也把很大一部分的关注点放在家庭暴力中女性权益的法律保护上。虽然在女性暴力犯罪中，犯罪行为的实施主体是女性，但在血腥暴力的背后是否还有更深层次的原因，女性的合法权益是否得到了法律公正的对待，这是我们应该进一步去探讨的课题。
[Abstract]:Female crime has always been a weak link in the theoretical study of criminology, but with the development of modern society, female crime has become an important factor affecting social harmony and stability. In academic research, it is also necessary to re-examine female crime from a new perspective and perspective. This article is written to focus on the specific dimension of female violence, which is caused by domestic violence. Put domestic violence and female violence in a chain of causation. In other words, the focus of the article is to detect the form of husband-to-wife violence in a couple relationship from a multi-level domestic violence. And from the more and more complex phenomenon of female crime, this paper singled out the crime of female violence caused by domestic violence as the trigger, and then combined the two together to carry on the analysis. On the basis of this, the author puts forward the prevention countermeasures of female violence crime from the angle of legislation, so as to better protect the legal rights and interests of women in the family. The first part of the article first leads to the basis of the full text through domestic violence, that is, domestic violence is an important inducement to the crime of female violence. This paper analyzes the phenomenon of domestic violence and the forming process of female violent crime in China. This paper points out the practical problems and their harmfulness in the current social life. The second part makes a macroscopic summary and analysis of the existing domestic violence laws and policies in China, the purpose of which is to comb and examine these laws and policies. Find and further put forward the defects and loopholes of the current legislation on the regulation of domestic violence. After the first two parts of the discussion and analysis, The third part focuses on the legislative level and from the perspective of legal protection to explore the domestic violence caused by female violence crime prevention measures, including the formulation of a unified law against domestic violence, The implementation of civil protection orders and the introduction of an expert witness system for battered women syndrome to make it a statutory sentencing circumstance. The crime of female violence has become a social phenomenon which can not be ignored. In the judicial cases, it shows more and more psychological characteristics and inducing factors which are unique to the male crime. In the writing of the article, much attention is also paid to the legal protection of the rights and interests of women in domestic violence. Although in the crime of female violence, the subject of the crime is the female. However, whether there is a deeper reason behind the bloody violence, whether the legal rights and interests of women have been treated justly by law, is a subject that we should further explore.
