儒教与犯罪控制

【摘要】: 本文的研究目的在于如何利用儒教进行犯罪控制,在内容上以犯罪学为中心,兼顾社会学、哲学、宗教学等知识。为了达到研究目的,借鉴儒教的犯罪控制理论,更好地对当前的犯罪进行控制,本文着重介绍了儒教与犯罪控制的关系以及当前中国对儒教犯罪控制理念的借鉴。全文主体部分一共分成五节进行了论述,论述过程注重前后的逻辑一致性。 在文章的第一部分,为了明确儒教的宗教性,本文首先介绍了宗教的概念,然后概述了儒教的产生、发展与现状。在中国古代,儒教作为中国传统教派,在中国传统文化中具有特殊的地位,虽没有国教之称,却对国家政权曾起着无可替代的作用。因此在犯罪控制方面儒教有自己一套理论和学说,并被应用到政治实践当中。 文章在第二部分介绍了儒教的犯罪观。儒教的人性观是犯罪观的形成基础。儒教的人性观以“人性善”为主,也有“性恶论”,不过在一点上是一致的,即重视道德教化和人格的培养。从人性善角度出发,儒教注重规范的正面指引,在自我修养的过程中保持善良的本性,在行为方式上遵循“中庸之道”,从而使社会保持良好的秩序。由于儒教受产生的历史条件的限制,其犯罪观难免有一定的局限性,不过也有可资借鉴的合理成分。 第三部分从政治、经济以及主观等角度介绍了几种犯罪成因的看法,为第四部分介绍儒教的犯罪控制理论打下了基础。儒教对犯罪成因的分析比较广泛,理论比较成熟,具有科学成分。在儒教的犯罪控制理论部分主要介绍了儒教在犯罪预防、犯罪控制(狭义)、犯罪惩处和犯罪矫正四个阶段的理论和措施。在本部分重点介绍了几种具体的犯罪控制措施。儒教在控制犯罪方面重视犯罪前的预防,这与儒教的人性观是分不开的,与儒教重视人格培养的礼教特征密切联系。 在文章的第五部分,结合中国当前犯罪形势,以儒教的犯罪控制理论为基础,探讨了当前中国如何利用儒教进行犯罪控制,实现和谐社会的问题,体现了全文的研究宗旨。 在文章的结语部分,在回顾全文的基础上,展望了儒教的发展前景和利用儒教进行犯罪控制的研究前景。在正处于致力于和谐社会建设的当代,作为社会的一分子理应贡献自己的微薄之力,希望笔者的粗陋开端能引起更多研究者的加入,“抛砖”意在“引玉”,倘能达此目的,笔者将甚是欣慰。
[Abstract]:The purpose of this paper is to make use of Confucianism to control crime, take criminology as the center in content, and give consideration to the knowledge of sociology, philosophy, religion, etc. In order to achieve the purpose of the research, the author draws lessons from the theory of crime control of Confucianism. This paper focuses on the relationship between Confucianism and crime control and the reference of the concept of Confucian crime control in China. The main part of this paper is divided into five sections. The process of discussion pays attention to the logical consistency before and after. In the first part of the article, in order to clarify the religious nature of Confucianism, this paper first introduces the concept of religion, then outlines the emergence, development and present situation of Confucianism. Confucianism has its own theory and doctrine in crime control and has been applied to political practice, because it has a special position in Chinese traditional culture, although it is not known as the state religion, it has played an irreplaceable role in the state power. In the second part, the author introduces the view of crime of Confucianism. The view of human nature of Confucianism is the foundation of crime view. The view of human nature of Confucianism is mainly "good human nature" and "the theory of sexual evil", but it is consistent in one point. From the point of view of humanity goodness, Confucianism pays attention to the positive guidance of norms and maintains the nature of goodness in the process of self-cultivation. Due to the limitation of the historical conditions of Confucianism, its view of crime is bound to have some limitations, but it also has reasonable elements to be used for reference. The third part introduces the views of several crime causes from the political, economic and subjective perspectives, which lays a foundation for the introduction of the crime control theory of Confucianism in part 4th. The analysis of the causes of crime is extensive and the theory is relatively mature. In the part of crime control theory of Confucianism, it mainly introduces the crime prevention of Confucianism, Crime control (narrow sense, crime punishment and crime correction of the four stages of theory and measures. In this part of the emphasis on the introduction of several specific crime control measures. This is inseparable from the Confucian view of human nature and closely related to the characteristics of Confucian ethics which attach importance to the cultivation of personality. In the 5th part of the article, combined with the current situation of crime in China, based on the theory of crime control of Confucianism, this paper discusses how to use Confucianism to control crime and realize harmonious society in China, which embodies the research purpose of this paper. In the conclusion of the article, on the basis of reviewing the full text, the author looks forward to the development prospect of Confucianism and the research prospect of using Confucianism to control crime. As a member of the society, we should contribute our own modest strength. I hope that the author's humble beginning can arouse more researchers to join in, "throwing bricks" is intended to "attract jade", if this purpose can be achieved, the author will be very gratified.
