论国家机关工作人员职务犯罪的控制模式

【摘要】: 国家机关工作人员的职务犯罪对国家的政治建设、经济建设具有较强的破坏作用。研究和健全职务犯罪的控制模式对预防职务犯罪、完善法治建设、提高党的执政能力与公信力具有积极的促进作用。 文章分为以下几个部分: 第一部分的内容为机关工作人员职务犯罪控制的概述。一是职务犯罪控制的理论基础。首先,规范机关工作人员职务行为是国家发展的需要。其次,控制职务犯罪的本质是限制公权、保障民权。二是我国机关工作人员职务犯罪的现状。我国机关工作人员的职务犯罪已经严重破坏了政府公信力和执政形象,损害了国家和民众的大量合法权益,影响了党的政治建设和法治建设。三是机关工作人员职务犯罪的特点。文章通过两则案例详细说明该类犯罪的特点,机关工作人员职务犯罪均是通过公权力对公共管理资源的集中控制,在外部与内部监督形同虚设的情况下,违背公务道德和职务行为正当性,以个人微弱的力量扭曲了国家强大的管理意志,用低廉的成本给国家和个人造成了巨大损失。四是世界各国对职务犯罪的控制模式。一些国家在反腐败和惩治职务犯罪的实践中积累了各具特色的成功经验。如道德教化、高薪养廉、法律严密、赋权惩治、政治透明、正本“浚源”等模式。注意多种措施的综合运用,正在成为当今世界反贪浪潮中引人注目的一种有效对策而受到越来越多的国家的青睐,只有对职务犯罪进行综合治理,才能达到标本兼治的目的。 第二部分的内容为我国对职务犯罪控制的现状。我国现有的职务犯罪控制模式中,道德教育和公众监督发挥的作用日益明显,但是缺少道德法制化和信息公开化的前提。纪检监察和司法监督是控制犯罪的根本保障,监督权利的独立行使与地方利益存在的矛盾仍需要进一步解决。内部监督中厘清监督者与被监督者之间的关系并建立监督者的权益保障机制是发挥内部监督优势的重要内容。 第三部分的内容为改善当前职务犯罪控制模式。第一,解决渎职犯罪轻刑化问题,增强对职务犯罪的震慑和惩治力度。第二,强化外部监督组织和监督权力的作用,依法对职务行为进行控权监督。第三,改善公共管理领域的内部监督,建立职务行为人的身份权益保障制度,注重职务行为的事中规范。第四,促进信息公开化,建立职务行为监督与职务犯罪侦查的信息体系,使职务犯罪控制模式具备灵敏的发现功能。第五,解决由少数机关工作人员决定大量社会公共管理资源分配的问题,改变资源分配方式。第六,加快机关工作人员道德法制化建设,用法律强制方式在职务思维中植入公平正义、恪尽职守的道德理念。
[Abstract]:The official crime of state organ staff has a strong destructive effect on the political construction and economic construction of the country. The study and improvement of the control mode of the duty crime can prevent the duty crime and perfect the construction of the rule of law. Improving the party's ruling ability and credibility has a positive role in promoting. The article is divided into the following parts:. The content of the first part is an overview of the control of official crime. First, it is the need of the development of the country to regulate the duty behavior of the staff of the organ. Second, it is the theoretical basis of the control of the duty crime. The essence of controlling job-related crimes is to limit public rights and protect civil rights. Second, the present situation of official crimes committed by government functionaries in our country. The official crimes committed by government functionaries in our country have seriously damaged the credibility of the government and the image of the ruling government. It has damaged a large number of legitimate rights and interests of the state and the public, affected the party's political construction and the construction of the rule of law. Third, it is the characteristics of official crimes committed by government functionaries. The article explains in detail the characteristics of this kind of crimes through two cases. The crime of official duties of the staff of the organs is the centralized control of the public management resources through the public power, and violates the public morality and the legitimacy of the duty behavior under the circumstances of external and internal supervision. The weak power of the individual distorts the country's strong will to govern, The low cost has caused great losses to countries and individuals. Fourth, the modes of controlling job-related crimes in various countries in the world. Some countries have accumulated their own unique successful experiences in the practice of fighting corruption and punishing job-related crimes, such as moral enlightenment. High pay, strict law, power and punishment, political transparency, original "dredging" and other models. Pay attention to the comprehensive use of various measures, Nowadays, it is becoming an effective countermeasure in the wave of anti-corruption in the world and is favored by more and more countries. Only by comprehensively controlling the crime of duty can we achieve the goal of treating both symptoms and symptoms. The second part is about the present situation of the control of duty crime in our country. In the existing duty crime control mode of our country, the role of moral education and public supervision is becoming more and more obvious. However, it lacks the premise of moral legalization and openness of information. Discipline inspection, supervision and judicial supervision are the fundamental guarantees for crime control. The contradiction between the independent exercise of supervisory rights and the local interests still needs to be further solved. In internal supervision, it is important to clarify the relationship between supervisors and supervisors and to establish the mechanism of safeguarding the rights and interests of supervisors. The content of the third part is to improve the current control mode of duty crime. First, to solve the problem of light punishment of dereliction of duty crime, to strengthen the deterrent and punishment of duty crime. Second, to strengthen the role of external supervision organization and supervision power. Third, to improve the internal supervision in the field of public administration, to establish the system of safeguarding the identity and rights and interests of the duty doers, and to lay stress on the standardization of the duties. Fourth, to promote the publicity of information. Establish the information system of duty behavior supervision and duty crime investigation, make the control mode of duty crime have sensitive discovery function. Fifth, solve the problem that a small number of agency staff decide the allocation of a large number of social public management resources. The sixth is to speed up the construction of the moral legalization of the staff of the organ, to imbue the fair and just in the thinking of duty with the compulsory way of law, and to fulfill the moral idea of due diligence.
