社会转型期老年人犯罪及其防控

【摘要】：随着社会的转型，老年人口在我国人口结构中所占比例不断增大，老年人犯罪已经成为我国一个不可忽视的社会问题。而且，，随着人口老龄化现象进一步加剧，老年人犯罪问题将更加突出。社会转型时期我国老年人犯罪呈现出农村老年人犯罪问题日趋严重、犯罪类型多样性、性犯罪不断增加、男性老年人犯罪发生率高于女性等特点。城镇化速度加快空巢现象严重、社会养老保障和体系不健全、针对老年人法律教育的缺失与落后以及老年人的生理和心理因素，成为导致老年人犯罪的主要的客观原因和主观原因。针对我国社会转型时期老年人犯罪的特点及成因，认为对老年人犯罪应当依次采取三级防控对策。一级防控对策包括适时调整计划生育政策、建立弹性退休制度、完善和构建老年人受教育制度及完善老年人权益保护法律制度等具体举措；次级防控对策包括重视对老年人道德与法制教育、关注老年人老有所养及支持老有所伴、依托社区大力发展居家养老服务等具体措施；第三级防控对策为老年人犯罪后刑事实体法的从宽处罚及刑事程序法方面的特殊保护。
[Abstract]:With the transformation of the society, the proportion of the elderly population in the population structure of our country is increasing, and the crime of the elderly has become a social problem that can not be ignored in our country.Moreover, as the aging of the population further intensifies, the problem of elderly crime will become more prominent.In the period of social transformation, the crime of the elderly in rural areas is becoming more and more serious, the types of crimes are diverse, the sexual crimes are increasing, and the incidence of crime among the male elderly is higher than that of the female.Urbanization speed up empty nest phenomenon is serious, social pension security and system is not perfect, in view of the lack and backwardness of legal education for the elderly, as well as the physiological and psychological factors of the elderly,It has become the main objective and subjective reasons for the elderly to commit crimes.In view of the characteristics and causes of the elderly crime in the period of social transformation in our country, the author thinks that three measures should be taken to prevent and control the elderly crime in turn.The first level prevention and control countermeasures include timely adjustment of family planning policy, establishment of flexible retirement system, improvement and construction of the education system for the elderly, and improvement of the legal system for the protection of the rights and interests of the elderly.The secondary prevention and control countermeasures include paying attention to the moral and legal education of the elderly, paying attention to the security of the elderly and supporting the elderly with partners, and relying on the community to vigorously develop the services for the aged at home.The third level is the lenient punishment of the criminal substantive law and the special protection of the criminal procedure law.
