中国私人侦探制度初探

【摘要】： 私人侦探在西方社会是发展成熟的服务类型行业,因专业化分工精细,从业人员素质高而受人尊崇,其社会地位不亚于医生与律师,是一种高风险和高利润回报的职业。而在我国来讲,私人侦探业尚属于新生事物,虽然在民国时期业已出现,但由于它的社会基础和经济基础都不是很成熟,加之人们的思想相对保守,以及社会纠纷和矛盾也少等种种原因,行业活动很快就陷入沉寂,直到上个世纪90年代中后期才得到长足的发展。可以说,自从行业开始出现至今,关于私人侦探业的存废一直是学术界讨论的焦点,一方面是私人侦探业无序发展和监控缺失,造成了一系列的社会负面效应,国家机关因此采取了相应的审慎的处理态度,出台了相关的禁令,进行了取缔；而从另一方面来看,则是在巨大的市场需求和高额的利润刺激下,私人侦探机构逐渐转入了半地下的经营。随着社会包容力的日渐提高,人们也越来越能够理解和支持这个行业的发展,这样就造成了中国的私人侦探队伍在无序中蓬勃发展壮大的一种混乱状态。在我国,私人侦探们的未来的将何去何从,取决于我们将采取何种态度去对待私人侦探。是因噎废食、予以封杀还是正视现实、强化管理,是默示其半地下的生存状态还是用给予其明确的合法地位,是重视打击其带来危害还是应该从源头上堵截其产生负面效应的根源。毫无疑问,后者应当是科学的选择,也是符合理性且思辨精神的。正视现实、立足长远、着眼未来,私人侦探的存在到底应不应该得到国家的认可,国家制定的法律又应当如何去更好的引导私人侦探业的发展,将其纳入到我们社会主义法制建设的轨道上来,让私人侦探业尽快走上理性而又有序的发展之路,这些问题值得学界认真的思考。
[Abstract]:Private detective is a mature service industry in western society. It is respected because of its fine specialization and high quality. Its social status is no less than that of doctors and lawyers. It is a profession of high risk and high profit return.In our country, the private detective industry is still a new thing. Although it appeared in the Republic of China, its social foundation and economic foundation are not very mature, and people's thoughts are relatively conservative.As well as social disputes and contradictions and other reasons, the industry quickly fell into silence, until the late 1990s to get considerable development.It can be said that since the emergence of the industry, the existence and abolition of the private detective industry has always been the focus of academic discussion. On the one hand, the disorderly development and lack of monitoring of the private detective industry have resulted in a series of negative social effects.As a result, the state organs adopted a corresponding prudent approach, issued a related ban and banned it; on the other hand, it was stimulated by huge market demand and high profits.Private detective agencies are gradually moving into semi-underground operations.With the increasing social tolerance, people are more and more able to understand and support the development of the industry, which has created a chaotic situation in which China's private detectives flourish in disorder.In our country, the future of private detectives depends on how we treat them.Is it to waste food because of choking, to block it or to face up to reality, to strengthen management, to imply its semi-underground living state or to give it a clear legal status,Whether to pay attention to the harm caused by it or to intercept the root causes of its negative effects at the source.There is no doubt that the latter should be scientific, rational and speculative.Facing up to reality, standing in the long run, looking to the future, whether the existence of private detectives should be recognized by the state or not, and how the laws formulated by the state should better guide the development of the private detective industry,Bring it into the track of our socialist legal system construction, let the private detective industry take the rational and orderly development road as soon as possible, these problems are worthy of serious consideration by the academic circles.
