就情境预防策略论青少年性犯罪预防之应对

【摘要】： 自人类文明发展进入突飞猛进的工业革命时代,伴随着社会物质条件的迅速丰富,包括青少年性犯罪在内的各种犯罪发生率也是水涨船高。在这个阶段中的一些犯罪预防手段,如刑罚、宗教、心理纠正、道德培育等,因过分专注于消灭犯罪,因此有司法预防的高成本、副作用,抑或社会预防的漫长效应等缺憾。而发源于上世纪六十年代的情境预防理论,天生地具有强针对、高效率和低投入特征,展现了某些传统犯罪预防理论所无法比拟的优越性。面对青少年性犯罪严峻形势,可以尝试在犯罪情境预防理论角度突破传统解决方案的弊端,并提出一些相关的预防基本设想。本文除引言和结语之外,分为四章: 第一章通过当代中国青少年性犯罪的现状描述,指出这种特殊犯罪现象在我国的发案率居高不下的严峻形势,并剖析其主要特征。第二章切入犯罪预防理论的发展历史,简要展开对情境预防理论沿革过程的探索和研究,并结合现实展示情境犯罪预防理论的实践成果。第三章根据情境预防理论的一些内在优秀理论品质,分析传统犯罪预防手段的优劣,着重展开情境预防理论应用于青少年性犯罪预防而产生的种种预期的主流价值分析,包括经济价值和社会价值等。第四章专门从情境预防角度出发,讨论青少年性犯罪控制和预防,在前文理论基础上形成一些有实践价值的具体情境预防措施,以期能遏制现阶段青少年性犯罪的高发势头。本文主要价值在于:面对青少年性犯罪这一课题,借由引入情境预防这一新型犯罪预防理论来转向更多从具体情境层次考虑的理论支持点,试图突破旧式低效的解决方案,充分论证情境预防理论针对该类犯罪所体现出来的创新因素,并提出一些相关的预防基本设想。通过本文的论述和设想来促进对青少年性犯罪长效预防制度的完善是对国家、民族希望的负责,也是文章的根本目的。
[Abstract]:With the rapid development of human civilization and the rapid development of the industrial revolution, with the rapid enrichment of social material conditions, the incidence of various crimes, including juvenile sex crimes, is also rising.In this stage, some means of crime prevention, such as punishment, religion, psychological correction, moral cultivation and so on, have some shortcomings such as high cost, side effect of judicial prevention, or long effect of social prevention, because they focus too much on the elimination of crime.The theory of situational prevention, which originated in the sixties of last century, has the characteristics of strong, high efficiency and low input, which shows the superiority of some traditional theories of crime prevention.In the face of the serious situation of juvenile sex crime, we can try to break through the drawbacks of traditional solutions in the theory of crime situation prevention, and put forward some basic prevention ideas.In addition to the introduction and conclusion, this article is divided into four chapters:The first chapter describes the current situation of juvenile sex crime in contemporary China, points out the severe situation of the high incidence rate of this special crime phenomenon in China, and analyzes its main characteristics.The second chapter focuses on the history of crime prevention theory, and briefly explores and studies the evolution of situational crime prevention theory, and displays the practical results of situational crime prevention theory combined with reality.The third chapter analyzes the advantages and disadvantages of the traditional crime prevention methods according to the internal excellent theoretical qualities of the situational prevention theory, and focuses on the analysis of the mainstream value of the application of the situational prevention theory to the juvenile sexual crime prevention.Including economic value and social value.The fourth chapter discusses the control and prevention of juvenile sexual crime from the perspective of situational prevention. Based on the previous theory, it forms some concrete situational prevention measures with practical value, in order to curb the high incidence of juvenile sexual crime at the present stage.The main value of this paper lies in: in the face of the subject of juvenile sexual crime, by introducing situational prevention, a new crime prevention theory, to turn to more theoretical support points considered from the specific situation level, trying to break through the old low-efficiency solution.This paper fully demonstrates the innovative factors embodied in situational prevention theory in view of this kind of crime, and puts forward some basic ideas of prevention.It is the responsibility of the nation and the nation to promote the perfection of the long-term prevention system of the juvenile sexual crime through the discussion and assumption of this paper, which is also the basic purpose of the article.
