【摘要】： 成本收益分析是法律经济学的主要研究方法。法律经济学是一门以经济学的角度分析法学问题的新兴学科,它不仅涉及到关法律价值等具有法哲学意义上的法学理论问题,而且涉及到具体的法律问题和几乎所有的部门法领域。法律经济学的方法论同样适用于刑事侦查活动。在刑事侦查活动中,国家投入大量的人力、物力和财力,即侦查成本,目的在于获取侦查收益,这就涉及到侦查过程的经济性问题。由于资源的稀缺性,我国侦查部门的办案资源严重缺乏,且存在资源配置不合理、利用不充分的情况,由此导致侦查工作的低效益。目前的侦查现状对经济分析方法的运用提出了现实性的要求,如何在有限的资源的基础上取得最大的侦查收益成为当今侦查理论界与实务界亟需解决的问题。将经济学研究领域与刑事侦查领域相融合,用经济学的理论和方法对侦查活动进行系统分析,标志着刑事侦查研究的方法论上的一次重大变革,填补了我国侦查理论研究的空白。第一部分,作者介绍了刑事侦查成本与收益分析的概念,并对其必要性,现实性、可行性及其理论与实践意义进行了阐述。第二部分,作者介绍了对刑事侦查活动进行成本与收益的基础理论,借助于微观经济学的相关原理,界定了刑事侦查成本与收益分析的逻辑起点与最终目标。其中着重介绍了“理性选择”、“帕累托最优状态”与“卡尔多.希克斯效率”的相关理论。第三部分,作者分别对刑事侦查的成本与收益进行了介绍,并指出了刑事侦查成本与收益分析的理论局限性,进而提出理论出路。第四部分,作者构建了理性犯罪人模型与刑事侦查边际收益递减规律模型,并加以适当的图示,目的在于以一种全新的方法论解决如何在资源有限供给的前提下最大化的提高侦查收益的难题。第五部分,着重于理论应用,作者将理性犯罪人模型与刑事侦查边际收益递减规律应用到我国的刑事侦查领域中,提出应在侦查领域树立效益意识、重新定位侦查破案率、运用刑案筛选系统、实施打击职业犯罪方案等相关命题,并在侦查权力成本与警力资源的优化配置方面提出若干建议。
[Abstract]:Cost-benefit analysis is the main research method of law and economics. Legal economics is a new discipline to analyze legal problems from the angle of economics. It not only involves the legal value and other legal theoretical issues in the sense of philosophy of law. It also involves specific legal issues and almost all branches of law. The methodology of law and economics also applies to criminal investigation. In criminal investigation activities, the state invests a lot of manpower, material resources and financial resources, that is, the investigation cost, the purpose of which is to obtain the investigation income, which involves the economic problem of the investigation process. Due to the scarcity of resources, the investigation departments in our country are seriously short of the resources for handling cases, and there is an unreasonable allocation of resources and inadequate utilization, which leads to the low efficiency of the investigation work. The present investigation situation has put forward the realistic request to the application of the economic analysis method. How to obtain the maximum investigation income on the basis of the limited resources has become the problem that needs to be solved urgently in the field of investigation theory and practice nowadays. Combining the field of economic research with the field of criminal investigation and systematically analyzing the investigation activities with the theory and method of economics, it marks a great change in the methodology of criminal investigation research. It fills up the blank of investigation theory research in our country. In the first part, the author introduces the concept of criminal investigation cost and income analysis, and expounds its necessity, reality, feasibility and its theoretical and practical significance. In the second part, the author introduces the basic theory of the cost and benefit of criminal investigation, and defines the logical starting point and the ultimate goal of the analysis of criminal investigation cost and income with the help of the relevant principles of microeconomics. "rational choice", "Pareto optimal state" and "Caldo" are emphasized. The theory of Hicks efficiency. In the third part, the author introduces the costs and benefits of criminal investigation, and points out the theoretical limitations of the analysis of the costs and benefits of criminal investigation, and then puts forward a theoretical way out. In the fourth part, the author constructs the rational criminal model and the law model of diminishing marginal income of criminal investigation, and gives appropriate diagrams. The purpose of this paper is to solve the problem of how to maximize the revenue of investigation on the premise of limited supply of resources with a new methodology. In the fifth part, focusing on the application of theory, the author applies the rational criminal model and the law of diminishing marginal income of criminal investigation to the field of criminal investigation in our country, and puts forward that we should set up the consciousness of benefit in the field of investigation and reposition the rate of detection and detection. By using the criminal case screening system, this paper puts forward some suggestions on the optimization of the cost of investigation power and the allocation of police resources, and puts forward some related propositions such as the scheme of cracking down on professional crime and so on.
