试论黑社会性质组织犯罪的成因及防控

【摘要】：当前,受国际政治经济一体化的影响,黑社会(性质)组织犯罪已然成为一个全球性的犯罪问题。虽然我国目前还没有形成像国外那种典型的黑社会组织,但带黑社会性质的犯罪组织已经在全国各地迅速的滋生和蔓延。其现状主要表现在：组织势力分布具有普遍性、组织结构比较严密、“保护伞”现象比较突出、境外黑社会渗透加剧等。近几年,黑社会性质组织犯罪在我国公安机关持续的高压打击下,嚣张气焰有所收敛,但仍有不断演化和升级的可能。在可预见的预来,黑社会性质组织不旦在“量”和“质”上有很大的提升,有向组织更加规模化、手段更加隐蔽化、形式日益多样、活动日益国际化等方向发展的趋势。因此,深入探讨黑社会性质组织犯罪的成因及其防控措施,对准确把握黑社会性质组织、有效打击黑社会性质组织犯罪,维护社会安定,保障人民生命财产安全有着重要的理论和现实意义。我国的黑社会性质组织犯罪的形成和发展的主要原因有：历史原因；国家社会、政治、经济、文化原因；境外黑社会组织的渗透原因；个人原因等。在构建黑社会性质组织犯罪的防控体系时,主要掌握好以下三方面：一要加强和完善刑事立法工作；二要多措并举,切实提高社会管控能力；三要讲究治理策略,从严打击黑社会性质组织犯罪。
[Abstract]:At present, under the influence of international political and economic integration, the organized crime of underworld has become a global crime problem. Although our country has not formed the typical underworld organization such as the foreign at present, but the criminal organization with the underworld nature has been growing and spreading rapidly in all parts of the country. Its present situation is mainly manifested in: the distribution of organizational power is universal, the organizational structure is relatively tight, the phenomenon of "umbrella" is more prominent, and the infiltration of overseas underworld is intensified. In recent years, the crime of underworld organization has been cracked down by the public security organs in our country, and the arrogance has been restrained, but there is still the possibility of continuous evolution and upgrading. In the foreseeable future, underworld organizations have a great improvement in "quantity" and "quality", and have a trend of developing in the direction of "quantity" and "quality", with more large-scale organizations, more hidden means, more diverse forms and increasingly internationalized activities. Therefore, it is necessary to probe into the causes of the organized crime of the underworld nature and its prevention and control measures in order to accurately grasp the triad nature of the organization, effectively crack down on the organized crime of the underworld nature, and maintain social stability. It is of great theoretical and practical significance to ensure the safety of people's life and property. The main reasons for the formation and development of the organized crime of underworld nature in our country are as follows: historical reasons; national social, political, economic and cultural reasons; infiltration reasons of overseas triad organizations; personal reasons and so on. In constructing the system of prevention and control of organized crime of the underworld nature, we should master the following three aspects: first, we should strengthen and perfect the criminal legislation; second, we should do more to improve the ability of social control and control; and third, we should pay attention to the strategy of governance.
