公共安全视角下的当代上海境外人员管理研究

【摘要】：我国境外人员管理是指国家政府主管机关依据宪法和有关法律、法规,对在中国的境外人员(香港、澳门、台湾居民、华侨以及外国人)入境、过境、出境和在我国境内居留、旅行及其他有关事务所实施的一种行政管理。从维护公共安全的角度出发,它是我国公安机关的一项专门业务,包括维护国家主权安全和社会稳定,在出入境管理中打击违法犯罪活动以及保护中外公民的合法权益,适应国家开放和经济建设的形势两方面的任务。加强境外人员管理,维护城市公共安全,是上海国际化大都市建设进程中不可回避、敏感性很强的问题,也是衡量城市综合管理工作水平的重要标准。当前,本市涉外不安定因素愈发突出,境外人员在沪违法犯罪活动日趋增多,非法移民问题初步显现,恐怖主义等非传统安全问题已经成为影响上海地区安全稳定的潜在因素,对国际化大都市建设健康发展构成威胁,因此也给构建和谐社会和2010年世博会安全构成了隐患。本文基于国际移民管理原则和理论,从公共安全视角针对当前涉外管理的现状和不足,直面涉外管理的挑战,抓住亟需提高的几个方面,积极思考上海境外人员管理工作,提出从转变观念、改革体制、健全机制、完善法制、规范执法、加强信息建设等方面进行努力,探索完善既具有中国特色、符合上海国际化大都市发展特点,又与国际通行做法接轨、符合国际惯例的工作机制,以实现对在沪境外人员的有效管理和优质服务,确保本市涉外领域安全和稳定。
[Abstract]:The administration of personnel outside China refers to the entry, transit, exit and residence in China of persons (Hong Kong, Macao, Taiwan residents, overseas Chinese and foreigners) in accordance with the Constitution, relevant laws and regulations, and in accordance with the Constitution and relevant laws and regulations. Strengthening the management of overseas personnel and maintaining urban public safety is an unavoidable and sensitive issue in the construction of Shanghai's cosmopolitan city. It is also an important standard to measure the level of urban comprehensive management. At present, the factors of instability concerning foreign affairs in this city are becoming more and more prominent, the illegal and criminal activities of foreign personnel in Shanghai are increasing day by day, the problem of illegal immigrants is initially emerging, and non-traditional security issues, such as terrorism, have become potential factors affecting the security and stability of the Shanghai region. It poses a threat to the healthy development of the international metropolis, and thus poses a hidden danger to the construction of a harmonious society and the safety of the 2010 World Expo. Based on the principles and theories of international migration management, this paper, from the perspective of public security, aims at the current situation and shortcomings of foreign management, directly faces the challenges of foreign management, and takes advantage of several aspects that need to be improved to actively think about the management of foreign personnel in Shanghai. It is proposed that efforts should be made to change ideas, reform the system, perfect the mechanism, perfect the legal system, standardize the law enforcement, and strengthen the construction of information, so as to explore and perfect both the Chinese characteristics and the development characteristics of Shanghai's cosmopolitan city. In order to realize the effective management and high quality service of the people outside Shanghai and ensure the safety and stability of the foreign field of the city.
