社会分层背景下侦查方法研究

【摘要】：进入21世纪以来,随着经济的不断发展,“变革”成为现如今中国社会的关键词。在这个过程中,社会资源的重新分配以及社会利益的调整正在当前中国社会不断上演。与此同时,犯罪问题也愈发凸显其与过去时代的不同。近几十年,中国的犯罪率不断攀升,其中尤为突出的是社会底层和所谓“精英”阶层的犯罪,其呈现一种哑铃式的犯罪形态。那么现代中国社会分层呈什么状态,在此状态下犯罪有什么新的特点以及如何创新侦查方法去应对社会分层引起的新的犯罪,都值得我们去研究,这也引起了我对当代中国侦查学与社会学理论交叉研究的思考。社会分层是一个社会学概念。社会分层广义上指的是按照一定的标准顺序把社会成员分成不同层次、等级的现象和过程。所谓侦查方法通俗的说就是侦查主体运用在侦查过程中的具体方法,侦查方法具有系统性、可选择性、工具性等特征。科学合理的侦查方法能够提高侦查的质量和效率,因此,侦查方法在整个侦查活动中有着很重要的作用。然而,在不断变化的的社会背景及犯罪形式压力下,侦查方法已经不能适应当前社会分层带来的犯罪问题,当前所运用的侦查方法的局限性不断凸显,因此侦查方法的创新发展就显得尤为的重要。本文中,笔者主要运用理论分析和比较研究的方法,着眼于当前实践,进行理论论证。当然,关与社会分层与侦查方法交叉研究的资料并不是很多,很难获得直接资料,这也是本人在论文写作和研究中的一大难点。文章结构按照提出问题、分析问题、解决问题的思路进行,通过对社会分层与犯罪之间关系的分析总结,探讨社会分层背景下研究侦查方法的意义,提出当前我国侦查方法存在的不足以及其革新面临的困境,通过对问题的深入剖析,围绕侦查主体、侦查权监督、侦查管理体系、特殊人群侦查控制以及创建有针对性侦查方法体系以完善侦查方法的应用。
[Abstract]:Since entering the 21 st century, with the development of economy, "reform" has become the key word of Chinese society. In this process, the redistribution of social resources and the adjustment of social interests are being performed continuously in Chinese society. At the same time, the problem of crime has become increasingly different from the past era. In recent decades, the crime rate of China has been rising, especially the crime of the social bottom and the so-called "elite" class, which presents a dumbbell crime pattern. Well, what is the state of social stratification in modern China, what are the new characteristics of crime under this state and how to innovate investigation methods to deal with the new crimes caused by social stratification, all of which deserve our study. This has also caused me to the contemporary Chinese investigation science and the sociology theory intersection research ponder. Social stratification is a sociological concept. In a broad sense, social stratification refers to the phenomenon and process of dividing social members into different levels and levels according to certain standard order. The popular method of investigation is the concrete method used by the subject in the process of investigation, which has the characteristics of systematization, selectivity and instrumentality. Scientific and reasonable investigation method can improve the quality and efficiency of investigation, therefore, investigation method plays an important role in the whole investigation activity. However, under the constantly changing social background and the pressure of crime form, the investigation method has been unable to adapt to the crime problem brought by the current social stratification, and the limitation of the investigation method used at present has become increasingly prominent. Therefore, the innovation and development of investigative methods is particularly important. In this paper, the author mainly uses the methods of theoretical analysis and comparative research, focusing on the current practice, theoretical demonstration. Of course, there is not a lot of information about the cross-research between social stratification and investigation methods, which is difficult to obtain direct data, which is also a big difficulty in my thesis writing and research. The structure of the article is carried out according to the idea of putting forward problems, analyzing problems and solving problems. Through the analysis and summary of the relationship between social stratification and crime, this paper discusses the significance of investigating methods under the background of social stratification. This paper points out the shortcomings of the investigation methods in our country at present and the difficulties it faces in its innovation. Through the in-depth analysis of the problems, it focuses on the subject of investigation, the supervision of investigation power, the investigation management system, and so on. Special crowd investigation control and the establishment of targeted investigation method system to improve the application of investigation methods.
