影响司法鉴定质量的因素分析及对策

【摘要】：司法鉴定是司法活动中的重要环节,在诉讼中具有不可替代的作用。司法鉴定质量,即司法鉴定意见是否准确、客观、公正,直接影响到司法公正和人民群众合法权益的保护。《全国人大常委会关于司法鉴定管理问题的决定》(以下简称《决定》)贯彻实施以来,新体制下的司法鉴定质量问题,正日益成为社会各界共同关注的焦点。笔者认为,只有找到影响司法鉴定质量的主要因素,并分析其产生的原因,才能找到解决问题的办法,保障司法鉴定质量,实现司法鉴定的公平公正。
[Abstract]:Judicial expertise is an important link in judicial activities and plays an irreplaceable role in litigation. The quality of judicial expertise, that is, whether the opinion of judicial expertise is accurate, objective and impartial, The decision of the standing Committee of the National people's Congress on the Administration of Judicial expertise (hereinafter referred to as "the decision") has directly affected judicial justice and the protection of the legitimate rights and interests of the people. Is increasingly becoming the focus of common concern from all walks of life. The author believes that only by finding the main factors that affect the quality of judicial expertise and analyzing the causes of its emergence, can we find a solution to the problem, guarantee the quality of judicial expertise, and realize the fairness and fairness of judicial expertise.
