符号互动理论视野下的犯罪原因研究

【摘要】：本文以犯罪学与社会学的交叉研究为主线，将符号互动理论及其方法引入犯罪学研究。以符号互动理论作为研究工具，对犯罪学中的互动中心论进行合理重构，并以其为基础对我国当下的犯罪原因进行深入而全面的研究。具体而言，本文的研究内容如下：第一，绪论部分。在本部分当中，本文将对文章的选题意义、相关研究现状、论文的研究框架及研究方法进行介绍。第二，作为工具的研究：符号互动理论释义。在本部分当中，本文拟通过对符号互动的含义、类型及作用的介绍，以及对符号互动的理论的历史回顾，全面介绍本文的理论基础：符号互动理论。第三，符号互动理论对犯罪学研究的启示——新互动中心论的确立。本部分将符号互动理论引入犯罪学研究，力图寻找到符号互动理论对犯罪原因研究的启示——新互动中心论，并对犯罪学中的罪行中心论、罪人中心论及已有的互动中心论进行评议，指出其在内涵、外延及体系逻辑上的不足之处。运用符号互动理论对互动中心论中的“互动”重新做出解释：扩大互动的范围（从加害——被害之间的互动扩展到整个人际层次的互动），使其能够准确地指导犯罪原因的研究。第四，犯罪原因的符号互动分析。本部分运用符号互动理论对犯罪原因进行研究，对我国已有犯罪原因研究进行检视，并认为不良符号互动是犯罪的基本动因之一。具体而言，社会中的人的行为并不是本能的、孤立的、无意识的，而是互动的产物。符号互动理论将能代表某种意义的事物（比如语言、文字、动作、物品乃至场景等）理解为符号，认为人的各种行为的产生及持续来自于行为主体对各种符号的意义的不同理解（比如中国人将红色理解为吉祥，因此会把婚礼等场合布置的红火热烈；一个人对另一个人的语言理解成辱骂，因而对其实施攻击行为）。笔者认为，犯罪的产生与行为主体对行为之前以及行为之时的“符号”的理解不无关系。良性的符号互动能够促成有益于社会的行为，而犯罪行为则与不良符号互动即符号本身的“恶”（此处的恶可理解为犯罪发生的可能性，下同），及行为主体对符号理解之“恶”有关。因此，笔者认为犯罪之所以产生，是不良符号互动的结果。此后，，本文将从“不良符号互动的犯罪人格形成作用”和“不良符号互动的犯罪行为促成作用”入手对不良符号互动说进行一般性分析。第五，不良符号互动对犯罪产生影响之举要。本部分将通过对仇恨犯罪、诈骗犯罪及食品安全犯罪的分析，具体说明不良符号互动对犯罪产生的深层影响。认为仇恨犯罪的行为人往往处于冲突当中，由于主客观因素的综合作用，使得行为人将冲其与被害人或者其他人的突理解为偏见、歧视、侮辱、嫉妒等。受这种心理状态的影响，行为人产生仇恨情绪，再加上我国传统复仇文化的刺激以及正当复仇途径的受阻，最终导致了仇恨犯罪的发生；诈骗犯罪是互动过程中受害人对加害人加害行为的错误理解导致的；而食品安全犯罪原因则主要是交换过程中获得利益与剥夺利益的相差悬殊。第六，结论部分。在本部分当中，笔者将对文章的观点进行总结。此外，犯罪原因研究的最终归宿是对犯罪的治理指导。因此，在本部分当中，笔者还将简要提出符号互动视野下的犯罪治理对策。
[Abstract]:This paper, taking the cross study of Criminology and sociology as the main line, introduces the theory of symbolic interaction and its method into the study of criminology. The theory of symbolic interaction is used as a research tool to reconstruct the interactive center theory in Criminology and to make a thorough and comprehensive study on the current cause of crime in China. The contents of the study are as follows:
The first part is the introduction. In this part, this article will introduce the significance of the article, the related research status, the research framework and research methods.
Second, as the research of tools: the interpretation of symbolic interaction theory. In this part, this article intends to introduce the theoretical basis of this article through the introduction of the meaning, type and function of symbolic interaction, and the historical review of the theory of symbolic interaction: the theory of symbolic interaction.
Third, the Enlightenment of the symbolic interaction theory to the criminology research - the establishment of the new interactive centrism. This part introduces the symbolic interaction theory into the criminology research, trying to find out the Enlightenment of the symbolic interaction theory on the study of the cause of the crime - the new interactive centrism, the Crime Center Theory in criminology, the center of the sinners and the existing interaction The theory of mind makes a review and points out its inadequacies in its connotation, extension and system logic. Fourth, the symbolic interaction analysis of the cause of the crime. This part uses the symbolic interaction theory to study the cause of the crime, examines the cause of the crime in our country, and thinks that the interaction of the bad symbols is one of the basic causes of the crime. Symbolic interaction theory, which represents something meaningful, such as language, words, movements, objects, and even the scene, holds that the generation and continuity of human behavior comes from the different understanding of the meaning of various symbols in the behavior subject (such as the Chinese people understand red as auspicious, so the wedding and other occasions will be taken. " The author thinks that the generation of crime and the behavior subject have nothing to do with the understanding of the "symbol" before the behavior and the behavior. The benign symbolic interaction can promote the behavior that is beneficial to the society, and the criminal act is the same. The negative symbol interaction is the "evil" of the symbol itself (the evil here can be understood as the possibility of crime, the same below), and the behavior subject is related to the "evil" of the symbol understanding. Therefore, the author thinks that the cause of the crime is the result of the interaction of bad symbols. After that, this article will form the role of the "criminal personality interaction" and "the interaction of the bad symbols". A general analysis is made on the interactive theory of bad symbols starting from the facilitating role of bad sign interaction.
Fifth, the influence of the bad symbol interaction on crime. This part will explain the deep influence of the bad symbol interaction on the crime by the analysis of the hate crime, the crime of fraud and the crime of food safety. The sudden understanding of the victim or the victim or other person will be understood as prejudice, discrimination, insult, jealousy and so on. Under the influence of this psychological state, the perpetrator produces hatred, and the stimulation of the traditional revenge culture of our country and the obstruction of the proper revenge way eventually leads to the occurrence of hate crime; the fraud crime is the victim in the process of interaction. The wrong understanding of the injurious act of the injurious person is the main reason for the crime of food safety.
Sixth, the conclusion part. In this part, the author will summarize the views of the article. In addition, the final result of the study of the cause of the crime is the guidance of the governance of the crime. Therefore, in this part, the author will also briefly put forward the Countermeasures of the crime governance under the vision of symbolic interaction.
