【摘要】： 本文所讨论的主要是宋代法医学的发展演进的情况。宋代以前,法医学的发展虽然缺少系统性和规模化,但是在《封诊式》里面就有了关于检验伤亡、出子等记载,秦汉时期的法医检验得到进一步发展。在宋代,先后出现了三部刑侦书籍即《疑狱集》、《折狱龟鉴》、《堂阴比事》。这三部刑侦书籍中的相同之处是对法医检验都有所涉及,这为宋慈编撰《洗冤集录》奠定基础,更为法医学在宋代获得突破性发展功不可没。 本文选择宋代法医学作为研究课题,其原因有以下几点：一是以法律史的专业角度来写宋代法医学的论文不多,专著缺乏。以前介绍古代法医学多是法医学方面的人士,他们写古代法医学无非是把它当作背景知识,稍作介绍,不够深入。二是宋代法医学自身的特点决定的。宋代法医学在中国法医学发展历程中具有不可替代的地位,它不仅影响到以后的朝代,对同时代的世界其他地区也具有借鉴意义。 全文由三部分组成,除引言、结语外,本论部分按法医学发展历史进程,简单做了划分,从宋代以前的法医检验、宋代三部刑侦书籍中的法医检验、宋代法医学的总体评价加以论述。 引言是对研究课题作出说明。本部分主要对选题的目的、意义、研究状况及资料收集情况,对写作的时间加以限定,运用比较分析的研究方法,对宋代法医学进行阐述。 正文部分是对宋代法医学发展状况的分段讨论。主要分为三个部分：一、宋代法医学的发展。宋代以前,法医学发展迟缓,《封诊式》、《素问》中有关于法医检验方面的记载,但这些书籍并不是专业书籍,因此,只是零星记载,缺少梳理。二、宋代三部刑侦书籍为宋代法医学的发展注入新的活力,使宋代法医学的发展展现出前所未有的速度。宋慈编撰的《洗冤集录》堪称第一部真正的法医学巨著,为以后法医学的发展形成定式。宋代法医学的具体运用。法医检验对于刑事案件来说,至关重要。刑事案件涉及伤亡需要法医检验,检验正确与否直接关系到案件的定性。三、是对宋代法医学的整体评价,分析成因,以期有一个全面论述。 本文在写作过程中运用了纵向比较的方法来研究主要问题,所谓纵向比较,主要是宋代三部刑侦书籍中所涉及的关于法医检验方面的内容,它们有一定的承继关系。
[Abstract]:This article mainly discusses the development and evolution of forensic medicine in Song Dynasty. Before the Song Dynasty, although the development of forensic medicine lacked systematicness and scale, there were records about the death and injury of examination, the birth of children and so on, in the "sealing mode", and the forensic examination in the Qin and Han dynasties was further developed. In the Song Dynasty, three criminal investigation books appeared successively, namely "suspicious prison collection", "broken prison turtle", "Tang Yin ratio affair". The similarities among these three forensic investigation books are all related to forensic examination, which lays the foundation for Song ci to compile the Collection of the Wash of grievances, and makes forensic medicine gain a breakthrough in the Song Dynasty. This article chooses the Song Dynasty forensic medicine as the research topic. The reasons are as follows: first, there are few papers and monographs of the Song Dynasty forensic medicine from the professional angle of the history of law. In the past, most of the people who introduced ancient forensic science were involved in forensic medicine. They wrote about ancient forensic medicine as background knowledge, but it was not deep enough. Second, the characteristics of forensic medicine in the Song Dynasty. Forensic medicine in Song Dynasty has an irreplaceable position in the development of forensic medicine in China. It not only affects the later dynasties, but also has reference significance to other parts of the world at the same time. The full text is composed of three parts, except introduction and conclusion, this part is divided into three parts according to the historical process of the development of forensic medicine, from the forensic examination before the Song Dynasty, from the forensic examination in the three forensic investigation books of the Song Dynasty, and from the forensic examination in the three forensic investigation books of the Song Dynasty. The general evaluation of forensic medicine in Song Dynasty was discussed. The introduction is an explanation of a research project. This part mainly focuses on the purpose, significance, research situation and data collection of the selected topic, limits the writing time, and expounds the forensic medicine of the Song Dynasty by using the comparative analysis research method. The main part is the section discussion on the development of forensic medicine in Song Dynasty. It is mainly divided into three parts: first, the development of forensic medicine in Song Dynasty. Prior to the Song Dynasty, forensic medicine was slow to develop, and there were records of forensic examination in the "sealed form" and "Su-Quan", but these books were not professional books, so they were only sporadic records and lack of combing. Second, three forensic investigation books in Song Dynasty injected new vitality into the development of forensic medicine in Song Dynasty, which made the development of forensic medicine in Song Dynasty show unprecedented speed. Song ci's compilation of the Collection of Remembrance of grievances is the first great work of forensic medicine, which forms a pattern for the later development of forensic medicine. The use of forensic medicine in Song Dynasty. Forensic examination is essential to criminal cases. Forensic examination is needed in criminal cases involving casualties, and whether it is correct or not is directly related to the qualitative nature of the cases. Third, the overall evaluation of forensic medicine in the Song Dynasty, analysis of the causes, with a view to a comprehensive discussion. In the process of writing, this paper uses the method of longitudinal comparison to study the main problems. The so-called longitudinal comparison is mainly the content of forensic examination in three forensic investigation books in Song Dynasty, which has certain inheritance relationship.
