我国社区矫正的困境及出路的思考

【摘要】： 发轫于西方的社区矫正是与监禁矫正相对的行刑方式,其人道、文明、有效的刑罚理念,体现了人类刑事法制建设文明与进步的程度。我国自2003年以来,相继在全国18个省、市、自治区开展了社区矫正的试点,社区矫正实践和相关的理论研究在中国方兴未艾。然而,这项在我国具有划时代意义的刑罚制度的改革和创新,在实践过程中,暴露不少问题和缺陷,极大制约社区矫正在我国健康有序发展,目前仍有大量的理论和实践问题需要探索和解决。笔者选择这一课题,旨在从社区矫正的定义及相关概念辨析出发,从社区矫正的起源、理论依据入手,并通过对国内外社区矫正的实践考察,分析我国社区矫正理论先天不足和令矫正流于形式和陷入困境的诸多因素,进而从立法完善、加强社区矫正制度建设,构建科学矫正体制和矫正制度以及发展“中途之家”模式方面,对重构我国社区矫正制度提出设想和展望。
[Abstract]:Community correction, which originated in the west, is a way of execution relative to imprisonment correction. Its humanitarianism, civilization and effective penalty concept reflect the civilization and progress of the construction of human criminal legal system. Since 2003, China has carried out the pilot of community correction in 18 provinces, cities and autonomous regions in China, community correction practice and related theoretical research. However, the reform and innovation of the epoch-making penalty system in China, in the course of practice, exposes a lot of problems and defects, which greatly restricts the healthy and orderly development of community correction in our country. At present, there are still a large number of theoretical and practical problems to be explored and solved.
The author chooses this subject, starting from the definition and related concepts of community correction, starting from the origin of community correction and the theoretical basis, and through the investigation of the practice of community correction at home and abroad, analyses the shortcomings of the theory of community correction in our country and the many factors that make corrections to form and fall into trouble, and then improve the legislation and add to the legislation. The construction of the system of strong community correction, the construction of the system of scientific correction and the system of correction and the development of the model of "home in the middle", put forward some ideas and prospects for the reconstruction of our community correction system.
