职务犯罪的成因与预防研究

【摘要】： 近年来,职务犯罪泛滥成灾,普遍地存在于各种权力领域中,成为现代国家肌体中的“恶性肿瘤”,严重损害了政府的公信力、侵害了经济基础,败坏了社会风气。如何更有效地预防职务犯罪是我们进行职务犯罪研究的目标。本文以“现象——成因——预防”这样一种基本的犯罪学研究范式为线索,对职务犯罪展开了深入的探讨。通过揭示职务犯罪这一现象的基本问题,包括职务犯罪的概念、特点和职务犯罪的现状、危害,提出职务犯罪的成因包括外部原因和内部原因。进而以职务犯罪的成因为职务犯罪研究中承前启后的因素,总结出职务犯罪的预防借鉴、预防措施和预防意义。并希冀本文可以对职务犯罪的预防工作提供一点理论支持。
[Abstract]:In recent years, job-related crimes are widespread in various fields of power and become "malignant tumors" in the body of modern countries, which have seriously damaged the credibility of the government, infringed on the economic base, and damaged the social atmosphere. How to prevent duty crime more effectively is the goal of our research. Based on the basic criminological research paradigm of "phenomenon-causation-prevention", this paper makes an in-depth study of job-related crime. By revealing the basic problems of the phenomenon of duty crime, including the concept, characteristics, present situation and harm of duty crime, the paper puts forward the causes of duty crime, including external and internal causes. Then, the author sums up the prevention reference, preventive measures and preventive significance of duty crime by taking the factors of connecting the past and the future in the research of duty crime. It is hoped that this paper can provide some theoretical support for the prevention of job-related crimes.
