基于多中心理论的环境群体性事件治理研究

【摘要】：随着公众环境权益意识的日渐增强,各类环境污染投诉逐年上升,环境问题备受瞩目,合理环境诉求日益成为公众普遍关注的焦点。因环境污染和生态保护引发的公众与企业对立、公众与政府对抗的环境群体性事件近年来频繁发生,冲击着正常的社会秩序,不利于社会安定团结。环境群体性事件的实质是多元利益群体间矛盾和冲突的一种表达,治理环境群体性事件,必须协调好各参与主体的利益。因此,各参与主体面临了一个共同的难题:如何有效治理环境群体性事件?在健全“党委领导、政府负责、社会协同、公众参与”的社会管理格局这一社会大背景下,立足多中心治理的理论基础,用多中心协同治理框架来探讨我国环境群体性事件治理无可厚非。本文以环境群体性事件治理中多元参与主体的分工与合作为研究主题,各主体在分工明确的基础上合作博弈、协同治理环境群体性事件。论述的重点围绕治理主体与治理结构展开,一是明确政府、企业、非政府组织以及公众这四个参与主体在环境群体性事件治理中的角色和职责定位;二是治理主体之间形成稳固的合作伙伴关系构建多中心协同治理结构。论文在形式上通过六个章节来安排。第一章,主要交代本论题得以确立的依据和写作的逻辑前提。第二章着重从环境群体性事件的界定以及其特殊性论述本文选取环境群体性事件这一论题的必要性和可行性,主要分析我国目前环境群体性事件治理现状以及存在的问题,通过对典型案例的分析,指出研究问题。第三章立足多中心理论的内涵,结合当前我国环境群体性事件现状,分析治理过程中多中心理论的适用性并对目前环境群体性事件治理存在的问题进行原因剖析。第四章,总结西方邻避冲突治理实践经验,结合我国目前的现实,为多中心协同治理环境群体性事件提供经验借鉴。第五章立足多中心理论,明晰环境群体性事件治理四大主体的职责,探索建立环境群体性事件协商对话机制,建立政府、企业、公众、非政府组织有效沟通、平等对话、协商解决的平台,有效治理环境群体性事件。第六章,总结研究现状,展望未来。
[Abstract]:With the increasing awareness of environmental rights and interests of the public, environmental pollution complaints are increasing year by year, environmental problems have attracted much attention. The appeal of reasonable environment has become the focus of public concern. The public and government against environmental mass incidents have frequently occurred in recent years because of the opposition of public and enterprises caused by environmental pollution and ecological protection. It is not conducive to social stability and unity to attack the normal social order. The essence of the environmental group events is an expression of the contradictions and conflicts among the multiple interests groups. To govern the environmental group events, the interests of the participants must be well coordinated. Therefore, the participants are confronted with a common problem: how to effectively govern the environmental groups. Under the social background of "Party committee leadership, government responsibility, social synergy and public participation" in the social context, it is based on the theoretical basis of multi-center governance, and it is impossible to discuss the governance of environmental groups in our country with multi center cooperative governance framework. On the basis of division of labor and cooperation, the main subjects are cooperative game on the basis of clear division of labor and cooperative governance of environmental group events. The emphasis of the discussion focuses on the governance subject and the governance structure. The first is to define the roles and responsibilities of the four participants in the governance of environmental group events. The two is to form a solid cooperative partnership between the subjects of governance to construct a multi center cooperative governance structure. The thesis is arranged in six chapters in form. The first chapter mainly explains the basis for the establishment of the thesis and the logical premise of the writing. The second chapter focuses on the definition of the environmental mass events and the selection of its particularity in this article. It is necessary and feasible to take the topic of environmental group events. This paper mainly analyzes the current situation and existing problems of environmental group event management in our country, and points out the research problems through the analysis of typical cases. The third chapter is based on the connotation of multi center theory, combined with the current situation of environmental group events in our country, and analyzes the process of governance. The applicability of multi center theory and the analysis of the existing problems of environmental group events governance. The fourth chapter, summarizing the practice experience of Western neighbouring conflict management, combining with the current reality of our country, provides experience for multi center collaborative governance environment group events. The fifth chapter is based on the multi center theory and clarifies the environmental group nature. The event manages the responsibilities of the four main bodies, exploring and establishing the mechanism of consultation and dialogue of environmental group events, establishing the effective communication between the government, the enterprise, the public, the non-governmental organizations, the equal dialogue, the settlement of the platform, and the effective governance of the environmental group events. The sixth chapter is a summary of the research and the prospect of the future.
