我国社区矫正审前调查评估制度研究

【摘要】：社区矫正制度是已被多年的司法实践证明了的,它有利于合理分配刑罚资源,有利于降低刑罚执行成本,有利于罪犯更好融入社会,是一项创新社会管理的重要举措,是深化司法体制改革的重要内容。审前调查评估制度作为开展社区矫正工作前的一个重要环节,对拟适用社区矫正的管制、缓刑、假释、暂予监外执行的犯罪分子的人身危险性进行社会调查和风险评估,以提高法院量刑的科学性和精准性,同时也有利于犯罪分子在没有完全封闭的社区环境中减缓反抗心理、减轻抗拒情绪,更好地接受教育改造。虽然我国刑法、刑事诉讼法、社区矫正实施办法等法律法规对审前调查评估制度有零零散散的规定,但《社区矫正法》至今还未正式出台,对审前调查评估制度缺乏系统的、统一的规定。由于我国关于审前调查评估制度的立法起步晚,缺少对审前调查评估制度规范的指导,目前我国审前调查评估制度存在主体局限性、程序随意性、内容不统一、文书质量低、方法片面性、监督不健全的问题,使得调查评估的效果受到了很大的限制,影响了其结论的公正性和客观性。因此,为尽快完善我国的审前调查评估制度,通过借鉴两大法系国家关于调查评估制度的先进经验,积极探讨符合本国实际的调查评估制度,对我国审前调查评估制度的主体、程序、内容、文书、方法和监督方面提出意见,并引入调查评估担保机制、制定调查评估测量表和健全调查评估监督制度等,将审前调查评估工作内容做到规范化、科学化、法治化。
[Abstract]:The community correction system has been proved by many years of judicial practice. It is conducive to the rational allocation of penalty resources, the reduction of penalty execution costs, and the better integration of criminals into society. It is an important measure to innovate social management and an important part of deepening the reform of judicial system. In order to improve the scientificity and accuracy of court sentencing, it is necessary to conduct social investigation and risk assessment on the personal danger of criminals who intend to apply community correction, suspension of sentence, parole and temporary execution outside prison. Although China's criminal law, criminal procedure law, community correction implementation methods and other laws and regulations have scattered provisions on the pre-trial investigation and evaluation system, but the "Community Correction Law" has not yet been formally promulgated, the pre-trial investigation and evaluation system is lack of systematic and unified provisions. The legislation of the pre-trial investigation and evaluation system started late and lacked the guidance to the norms of the pre-trial investigation and evaluation system. At present, there are some problems in the pre-trial investigation and evaluation system in China, such as the limitation of the main body, the arbitrariness of the procedure, the inconsistency of the contents, the low quality of the documents, the one-sidedness of the methods, and the imperfection of the supervision. Therefore, in order to perfect the pre-trial investigation and evaluation system in China as soon as possible, by drawing lessons from the advanced experience of the countries of the two legal systems on the investigation and evaluation system and actively discussing the investigation and evaluation system in line with their own reality, the main body, procedures, contents, documents, methods and supervisors of the pre-trial investigation and evaluation system in China are discussed. We should put forward our opinions, introduce the guarantee mechanism of investigation and evaluation, formulate the investigation and evaluation survey form and perfect the supervision system of investigation and evaluation, so as to standardize, scientifically and legally the work of pre-trial investigation and evaluation.
