心理跟踪技术在侦查讯问中的应用研究

【摘要】：近年来,公安机关、检察机关在一些刑事案件侦查讯问的过程中,不仅使用传统的侦查和讯问手段,也借助一些心理测试设备和技术来侦破疑难案件。心理跟踪技术作为心理测试技术的一项重要延伸技术,也逐渐被研发和重视起来,心理跟踪技术应用于侦查讯问中能够更多的发现犯罪嫌疑人想要隐藏的一些重要信息,而这些信息也很有可能成为破获整起案件或寻找案件相关隐藏线索的关键。因此,对于心理跟踪技术在侦查讯问中所起的作用有研究的必要性。心理跟踪技术是侦查人员借助心理跟踪仪,通过言语刺激,收集犯罪嫌疑人异常的生理反应信息,从而追踪其心理痕迹的新型侦查讯问技术手段。心理跟踪技术应用于刑事侦查活动中,增加了侦查人员收集案情信息的渠道,了解犯罪嫌疑人的人格特点,对侦查活动的进一步开展提供具体指导。目前,心理跟踪技术在检察机关、公安机关中处于初级阶段,但其经济犯罪侦查、职务犯罪侦查中已经获得了较为理想的效果。该技术操作简洁,对被测试者束缚性小,可以伴随侦查讯问同步进行,从而为传统讯问附加技术支持,提高讯问质量,为刑事案件提供线索,缩小侦查范围。心理跟踪仪的使用,不仅能够及时的监控到犯罪嫌疑人的生理心理变化,而且还能通过仪器的监测掌握其心理波动来提高破案效率,同时配备全程录音录像的功能,也能更好防止一些非法手段获取证据。测试的结果虽然不能直接作为证据使用,但却为侦查讯问的过程中起到很大的辅助作用。因此,对该项技术的科学性、操作性和应用推广的研究具有很好的前瞻性和迫切性。本文主要从心理跟踪技术的基础、实验结果、推广应用以及尚待解决的问题几个方面入手进行一些探讨和研究,使心理跟踪技术能够更好的在刑事案件侦查讯问中发挥作用,为侦查讯问提供更多切入点,提高讯问的科学性。研究心理跟踪技术也符合当下对科学讯问、合法讯问的紧迫要求,具有很大的现实意义。
[Abstract]:In recent years, public security organs and procuratorial organs not only use the traditional means of investigation and interrogation, but also use some psychological testing equipment and techniques to detect difficult cases in the process of investigation and interrogation of some criminal cases. As an important extension of psychological testing technology, psychological tracking technology has gradually been developed and paid attention to. Psychological tracking technology can be used in investigation and interrogation to find more important information that criminal suspects want to hide. And this information is also likely to be the key to unraveling the entire case or finding hidden clues related to the case. Therefore, it is necessary to study the role of psychological tracking technology in investigation and interrogation. Psychological tracking technology is a new technique of investigation and interrogation by means of psychological tracker and speech stimulation to collect abnormal physiological reaction information of criminal suspects and track their psychological traces. Psychological tracking technology is applied to criminal investigation activities, which increases the channels for investigators to collect information on the facts of the case, understand the personality characteristics of criminal suspects, and provide specific guidance for further development of investigative activities. At present, psychological tracking technology in procuratorial organs, public security organs in the primary stage, but its economic crime investigation, duty crime investigation has achieved a more ideal effect. The technique is simple in operation and less bound to the testees. It can be carried out in parallel with investigation and interrogation, thus providing additional technical support for traditional interrogation, improving the quality of interrogation, providing clues for criminal cases and narrowing the scope of investigation. The use of the psychological tracker can not only monitor the physiological and psychological changes of the suspect in a timely manner, but also improve the efficiency of solving a case by monitoring the psychological fluctuation of the criminal suspect, and at the same time be equipped with the functions of the whole process of recording and recording. It also makes it easier to prevent illegal means of obtaining evidence. Although the results of the test can not be directly used as evidence, they play a very important role in the investigation and interrogation. Therefore, the research on the science, operation and application of the technology is forward-looking and urgent. This article mainly from the psychological tracking technology foundation, the experiment result, the popularization application and the still to solve several aspects to carry on the discussion and the research, enables the psychological tracking technology to play the role in the criminal case investigation interrogation better, To provide more entry points for investigation and interrogation, and to improve the scientific nature of interrogation. The research on psychological tracking technology also accords with the urgent requirement of scientific interrogation and legitimate interrogation, and has great practical significance.
