唐宋遗嘱继承制度比较研究

【摘要】： 唐、宋在中国历史上都具有重要的地位,是中国封建社会在物质财富和精神文化方面的翘楚。唐、宋的法制是中国传统法制的完备时期,在封建法制史具有重要地位。唐宋时代,传统民事法律制度也发展到了一个新的水平,就传统财产继承制度方面的遗嘱继承制度而言,这一阶段承前启后,极具代表性。唐代遗嘱继承制度取自汉以来的精华,而宋代则进一步细化,并更加完善,两者一脉相承,又各具特色。本文从比较法的研究视角,在对唐宋遗嘱继承制度的发展完善进行分梳的同时,对唐宋继承制度的历史特点,社会意义及现代价值深入探析。全文由引言、正文及结语三大部分组成。在首先肯定中国古代确实存在遗嘱继承,并简单叙述了唐以前遗嘱继承的发展轨迹之后,于正文部分论析了以下三个大的问题:其一,唐宋遗嘱继承制度的主要内容,通过对唐宋继承制度的主要内容的描述,从而表明,遗嘱继承在此阶段制度已经得以确立,并且完善,而且在司法实践中具有极强的实用性。本部分集中介绍了唐宋时代遗嘱继承的适用范围、遗嘱的形式和订立手续、遗嘱的履行和纠纷的解决等主要内容。其二,从比较的视角,剖析唐、宋遗嘱继承制度的联系与区别,从而发现两个时期的遗嘱继承制度既具有紧密的联系,又风格迥异,而这种现象则是由各种复杂的因素所导致的。其三,通过对唐宋遗嘱继承制度在当时的社会意义及其对此后的传统社会的积极和消极影响的分析,对其历史意义进行探析,同时结合当代社会的遗嘱继承制度发掘其现代法律文化价值。
[Abstract]:Tang and Song played an important role in Chinese history and were the leaders of Chinese feudal society in material wealth and spiritual culture. The legal system of Song Dynasty was the complete period of Chinese traditional legal system. During the Tang and Song dynasties, the traditional civil law system also developed to a new level. In terms of the testamentary succession system in the traditional property inheritance system, this stage is a link between the past and the future. Tang Dynasty testamentary succession system is taken from the essence of the Han Dynasty, while the Song Dynasty is further refined, and more perfect, the two continue in the same vein, but also have their own characteristics. This article from the perspective of comparative law. In the Tang and Song Dynasty testamentary succession system development and improvement of the development of combing, the Tang and Song inheritance system of historical characteristics, social significance and modern value in-depth analysis. The full text is composed of introduction, text and conclusion three parts. After affirming the existence of testamentary succession in ancient China and briefly describing the development of testamentary succession before the Tang Dynasty, this paper discusses the following three major problems in the main body: first. The main content of the testamentary succession system in Tang and Song dynasties, through the description of the main content of inheritance system in Tang and Song dynasties, it shows that testamentary succession system has been established and perfected in this stage. And in the judicial practice has a strong practicability. This part focuses on the Tang and Song Dynasty testamentary succession application scope, will form and make procedures, will performance and dispute settlement and other main content. 2. From the perspective of comparison, this paper analyzes the relationship and difference between the testamentary succession system of Tang and Song dynasties, and finds that the testate succession system of the two periods has close connection and different style. This phenomenon is caused by a variety of complex factors. Third, through the Tang and Song Dynasty testamentary succession system in the social significance and the traditional society after the positive and negative impact analysis. At the same time, combining the testamentary succession system of contemporary society to explore its modern legal and cultural value.
