【摘要】： 作为中国共产党第一代、第二代中央领导核心的代表毛泽东、邓小平,在把马克思主义普遍原理与中国实际相结合、把我国建设成为社会主义法治国家过程中取得的宝贵的理论财富。二者既存在着广泛的一致性,又有着众多的不同点。加强对毛泽东邓小平法治思想的比较研究,不仅有利于深化毛泽东思想和邓小平理论的研究,而且有利于更好地坚持和发展毛泽东邓小平的法治思想,同时对我国现在进行的依法治国,建设社会主义法治国家也有重要的指导意义。本文分为三个部分: 第一部分,比较毛泽东邓小平法治思想的一致性,从社会主义法律职能认识上、立法认识上、司法实践认识上的这些方面进行对比,然后从理论来源、政治信仰、实践基础三个方面,分析了毛泽东邓小平法治思想存在一致性的原因。第二部分,比较毛泽东邓小平法治思想的差异性,从法治的地位作用认识上、法治功能的理解上、党与法的关系、政策与法律的关系这些方面进行了对比,然后从时代背景、社会条件、思维模式三个方面,分析了毛泽东邓小平法治思想存在差异性的原因。第三部分,在比较研究和分析的基础上,从依法执政、科学立法、特色法治道路和建设社会主义政治文明等四个方面,总结出毛泽东邓小平法治思想比较研究对我国正在进行的法治建设的启示。
[Abstract]:Mao Zedong, the representative of the second generation of central leadership and the first generation of the Communist Party of China, is combining the universal principles of Marxism with the reality of China. To build our country into a socialist country ruled by law in the process of making valuable theoretical wealth. There are many different points. To strengthen the comparative study of Mao Zedong Deng Xiaoping's thought of the rule of law is not only conducive to deepening the study of Mao Zedong thought and the theory of Mao Zedong. Moreover, it is beneficial for Mao Zedong to adhere to and develop Mao Zedong's thought of ruling by law better, and at the same time, it has important guiding significance for our country to run the country according to law and to build a socialist country ruled by law. This paper is divided into three parts: The first part is to compare the consistency of Mao Zedong Deng Xiaoping's thought on the rule of law, from the socialist legal function, legislative understanding, judicial practice understanding of these aspects of comparison, and then from the theoretical sources. Political belief, practice basis, analyzed Mao Zedong Deng Xiaoping rule of law thought existence consistency. The second part compares the differences of Mao Zedong's thought on the rule of law, from the view of the role of the rule of law, the understanding of the function of the rule of law, the relationship between the party and the law, the relationship between the policy and the law. Then, from three aspects of background, social condition and thinking mode, the author analyzes the reasons of the difference in Mao Zedong's thought of the rule of law. The third part, on the basis of comparative study and analysis, from the four aspects of ruling by law, scientific legislation, characteristic rule of law road and building socialist political civilization. This paper sums up the enlightenment of the comparative study of Mao Zedong's thoughts on the rule of law to the construction of the rule of law in our country.
