中世纪英国法律职业共同体的形成及影响

【摘要】： 随着我国司法改革的日益推进,法律职业问题越来越受到人们的重视。通过构建我国的法律职业共同体来推进司法改革,实现法治现代化,已成为法律界的基本共识。本文通过对英国普通法的形成,英国司法独立的产生以及英国学徒制培养模式的出现的介绍,分析了英国法律职业阶层产生的背景、原因以及英国法律职业共同体的形成机制,表明了法律职业共同体的产生需要具备诸多的历史条件,包括法律的至高无上,司法的独立以及共同的知识背景和志趣爱好的形成等。希望通过对本文的分析研究,为我国的法律职业共同体的构建模式和路径选择提供可资借鉴之处。
[Abstract]:With the development of judicial reform in our country, people pay more and more attention to the issue of legal profession. By constructing the legal profession community in our country, we can promote the judicial reform and realize the modernization of the rule of law. This paper analyzes the background of the formation of English common law, the emergence of judicial independence in England and the emergence of British apprenticeship training model. The reasons and the formation mechanism of the legal professional community in England show that the emergence of the legal professional community needs many historical conditions, including the supremacy of law. The independence of the judiciary and the formation of common knowledge background and interest are hoped to provide a reference for the construction mode and path choice of the legal professional community in China through the analysis and study of this paper.
