墨子法律思想研究

【摘要】：法律传统是指从过去沿袭传承到现在,而且仍在发挥作用的民族的法律精神和法律文化。法律传统作为民族传统文化中不可或缺的重要组成部分,具有着深厚的社会基础,它已深深地积淀于广大民众的意识、习惯、心理中,支配着人们的行为,因此,影响着当下社会法治建设的各个环节,甚至制约着当代中国法治建设的未来走向。因此,我们只有深刻地了解本民族的传统法律文化,吸收其中的精华部分,才可能制定出适合本民族实际情况的法律制度,这对于我们的社会主义的法治建设有着重要的意义。墨子作为先秦时期唯一的小生产阶级的思想代表,其法律思想在先秦思想史上,必然与儒、法等各家的思想有着本质的差异,具有其独特之处。笔者认为,墨子以“兼相爱,交相利”为核心内容的法律观,对后世产生了深远的影响。本文试图从法律文化学的角度,在分析墨子法律思想产生的时代背景、理论渊源的基础上,通过对墨子法律思想的主要内容的介绍及对墨子法律思想的评价,进而说明墨子法律思想的现代价值。论文分为四个部分,第一部分,分析墨子法律思想的产生,介绍墨子其人,探讨墨子法律思想产生的时代背景及其理论渊源。第二部分,系统介绍墨子法律思想的内容,即“一同天下之义”的法律起源论、“以天为法”的法律来源及效力理论、“兼相爱,交相利”为核心的法律观等。第三部分,对墨子法律思想予以评价,既总结墨子法律思想的理论贡献,也指陈其局限性,并概述其对后世思想的影响。第四部分,重点论述墨子法律思想的现代启示,探讨墨子法律思想对当今社会主义法治建设的积极意义。
[Abstract]:Legal tradition refers to the legal spirit and legal culture of a nation that has passed on from the past to the present and is still playing a role. As an indispensable part of national traditional culture, legal tradition has a deep social foundation. It has been deeply accumulated in the consciousness, habit and psychology of the general public, so it dominates people's behavior. It affects every link of the construction of the rule of law in the present society, and even restricts the future trend of the construction of the rule of law in contemporary China. Therefore, only when we deeply understand the traditional legal culture of our nation and absorb the essence of it can we formulate a legal system suitable to the actual situation of our nation, which is of great significance to our socialist construction of the rule of law. Mozi as the thought representative of the only small production class in the pre-Qin period, his legal thought in the history of pre-Qin thought must have the essential difference with the Confucianism, the law and so on each school thought, has its unique place. The author believes that Mozi's legal concept of "love and mutual benefit" has had a profound impact on later generations. In this paper, from the angle of legal culturology, on the basis of analyzing the background and theoretical origin of Mozi's legal thought, the author introduces the main content of Mozi's legal thought and evaluates the legal thought of Mozi. Then explains the modern value of Mozi's legal thought. The paper is divided into four parts. The first part analyzes the emergence of Mozi's legal thought, introduces its people, and probes into the background and theoretical origin of the legal thought. The second part systematically introduces the content of Mozi's legal thought, that is, the theory of legal origin of "sharing the meaning of the world", the legal source and validity theory of "taking Heaven as the Law", and the legal view of "both love and mutual benefit" as the core, and so on. In the third part, Mozi's legal thought is appraised, which not only summarizes the theoretical contribution of Mozi's legal thought, but also summarizes its limitation, and summarizes its influence on the thought of later generations. The fourth part focuses on the modern enlightenment of Mozi's legal thought, and probes into the positive significance of Mozi's legal thought to the construction of socialist rule of law.
