法律译者“共同起草人”身份探究

【摘要】：法律翻译本身具有国家实践性质,国际商务法律文本制定呈现国际化趋势,法律术语翻译多有不对等现象,这些都对法律译者主体的身份提出新的要求。商务法律译者"共同起草人"(co-drafter)身份定位具有合理性,从《中华人民共和国海商法》英译本中的"船舶优先权"和"船舶置留权"的误译,可以看出我国法律译者认识自身作为法律"共同起草人"的必要性。
[Abstract]:Legal translation itself has the nature of national practice, the international trend of international business legal texts development, legal terms translation often have unequal phenomenon, all of these put forward new requirements on the status of legal translators. The position of "co-drafter" (co-drafter) of the translator of business law is reasonable, and the misinterpretation of "maritime lien" and "lien on ship" in the English translation of Maritime Law of the people's Republic of China (PRC). It can be seen that it is necessary for Chinese legal translators to understand themselves as "co-drafters" of law.
