从锐邦诉强生案看价格机制对市场行为的影响

【摘要】：本文以锐邦诉强生案案情为出发点,通过对案中的转售价格维持条款进行反垄断法上的分析,引出了价格机制对转售价格维持条款的潜在影响,从而得出价格机制和价格政策能在很大程度上影响垄断协议当事人的市场行为的论断,为我国反价格垄断执法提供了一条新的思路。
[Abstract]:Based on the case of Ruibang v. Johnson, this paper analyzes the resale price maintenance clause in the case, and leads to the potential influence of the price mechanism on the resale price maintenance clause. The conclusion that the price mechanism and price policy can greatly affect the market behavior of the parties to the monopoly agreement provides a new way of thinking for the enforcement of anti-price monopoly in China.
