依法治国进程中我国公民法律信仰问题研究

【摘要】：自从党的十五大提出“依法治国,建设社会主义法治国家。”党引领着全社会进行了不懈的努力,使依法治国取得了令人瞩目的成绩。与此同时,我国法律法规也逐步完善,但是,法律法规的完善并不等于就有了完善的法治。我国仍然存在众多法治问题,譬如司法腐败、社会大众漠视权利等,我们不得不承认,我国离真正的法治社会仍有很长的距离。法律信仰是依法治国的基础,且依法治国的前提是公民拥有起坚定的法律信仰,公民对法律的信仰程度是依法治国的进度的决定性因素。然而,我国公民在立法、执法、司法、守法各个方面无不表现出法律信仰的严重缺失,这已成为制约我国依法治国进程的关键性原因。本文从法律信仰的含义、提出以及主客体三方面对法律信仰进行阐述,论证法律信仰对依法治国进程拥有推动性的现实意义,指出我们公民在立法、执法、司法、守法四个方面缺失法律信仰的表现,并从历史和现实两个角度分析了我国公民法律信仰缺失的原因,针对这些原因努力寻找一条培育我国公民法律信仰的有效途径,以期促进我国的依法治国进程。结合我国依法治国的现状,本人认为,应从法律信仰的主体公民和法律信仰客体法律两方面探讨法律信仰的培养的路径。总体来说,从法律信仰主体考察,要强化公民的法律和权利意识,加深公民对法律价值和作用的认同感,培养公民对法律的信服心理。从法律信仰客体考察,要科学立法、严格执法、公正司法,保证立法律制定的质量、确立法律的权威、树立法律至上观念。
[Abstract]:Since the 15th National Congress of the Party proposed to "rule the country according to law, building a socialist country ruled by law." The Party has led the whole society to make unremitting efforts and made remarkable achievements in governing the country according to law. At the same time, China's laws and regulations are gradually improved, but the perfection of laws and regulations does not mean that there is a perfect rule of law. There are still many legal problems in our country, such as judicial corruption, social disregard of rights and so on. We have to admit that our country is still a long way from the real society of rule of law. Legal belief is the basis of governing the country by law, and the premise of ruling the country by law is that citizens have firm legal beliefs, and the degree of belief in law is the decisive factor in the progress of governing the country by law. However, our citizens in the legislation, law enforcement, justice, law-abiding all aspects of the serious lack of legal belief, which has become the key reason for restricting the process of ruling the country by law. This paper expounds the legal belief from the meaning of legal belief and the subject and object, demonstrates the practical significance of legal belief in promoting the process of governing the country according to law, and points out that our citizens are legislating, enforcing the law, and administering justice. This paper analyzes the reasons for the lack of legal belief in China from the historical and practical perspectives, and tries to find an effective way to cultivate the legal belief of citizens in China in view of these reasons. In order to promote our country's process of governing the country according to law. Combined with the current situation of ruling the country by law, I think that we should explore the cultivation path of legal belief from two aspects: the subject citizen of legal belief and the law of object of legal belief. In general, from the perspective of the subject of legal belief, it is necessary to strengthen citizens' consciousness of law and right, deepen their sense of identity to the value and function of law, and cultivate their psychology of conviction to the law. From the object of legal belief, we should legislate scientifically, enforce the law strictly, just judicature, guarantee the quality of making law, establish the authority of law and establish the idea of law supremacy.
