社科法学的跨界格局与实证前景

【摘要】：随着中国法学的逐渐恢复和发展,法学在跨学科的法律研究上有了新进展,这便是在原先的法律研究上更加注重实证的研究方法:社科法学。自从苏力在讨论中国法学格局时提出这一称谓后,十多年来,社科法学得到了很快的发展,并且愈加得到法律人的重视。于是,社科法学便与传统的法教义学逐渐有了对立之势。在众多法学的研究方法之中,法教义学能够恰到好处地体现法律人的知识和思维能力,但是社科法学却以它自成一派的亲和力以及更加能够对社会额公共政策给予满足的优势脱颖而出。从目前的发展状况来看,社科法学会在中国有一席之地,甚至可能比一些欧美国家发展得更加出色。本文从社科法学的发展实况出发,浅谈社科法学的跨界格局与实证前景。
[Abstract]:With the gradual recovery and development of Chinese legal science, there has been a new development in the interdisciplinary legal research of law, which is a research method that pays more attention to empirical research in the former legal research: social Science Law. Since Su Li put forward this title when discussing the pattern of Chinese law, the law of social science has developed rapidly in the past ten years, and has been paid more and more attention to by law people. As a result, social science jurisprudence and the traditional doctrine of law gradually have the opposite trend. Among the many research methods of jurisprudence, the doctrine of law can appropriately reflect the knowledge and thinking ability of the legal person. However, social science law stands out because of its unique affinity and its ability to satisfy public policies. Judging from the current situation, the Society of Social Science Law has a place in China, perhaps even better than some European and American countries. Based on the development of social science law, this paper discusses the cross-boundary pattern and empirical prospect of social science law.
