论贾谊的“礼法”观

【摘要】： 贾谊,西汉时期著名的思想家、政治家、文学家。他不仅继承了儒家的文化理念,而且将法、道等各家的思想相融合。通过对汉初社会的现状进行分析与研究,形成了独具特色的“礼法”观。本文从贾谊礼法观的起源、内容、特点、影响等方面,对其展开了探究。通过研究,笔者认为,贾谊的“礼法观”既是对先秦诸子礼法思想的批判继承,也是对汉代实现长治久安的社会理想的途径设计与前景展望,其中不乏合理成份,值得今人借鉴。笔者认为,贾谊将先秦诸子尤其是先秦儒家的礼法思想进行了制度化的提升和深化,是贾谊礼法观的突出贡献。其次,贾谊强调“礼法合流”的综合治理在实现社会有序中的价值与意义的思想,对当代中国建设和谐社会,具有重要的启迪意义。尽管贾谊的这些思想因受到汉代各种条件的限制而未能最终变成现实,但是,其礼法观对后世的深远影响,是不可否认的历史事实。为此,本文从四个方面对贾谊的“礼法”观进行探讨。第一章,论述贾谊“礼法”观形成的历史条件和理论基础;第二章,重点介绍贾谊“礼法”观的体系构成;第三章,对贾谊与孔、孟、荀“礼法”观进行比较;第四章,论述贾谊“礼法”观历史影响与当代启示。
[Abstract]:Jia Yi, a famous thinker, politician and writer in the Western Han Dynasty. He not only inherits the Confucian cultural idea, but also merges the thoughts of law, Tao and so on. Through the analysis and study of the present situation of the early Han Dynasty, the unique concept of "etiquette law" was formed. This paper probes into the origin, content, characteristics and influence of Jia Yi's concept of etiquette and law. Through the research, the author thinks that Jia Yi's "concept of etiquette and law" is not only a critical inheritance of the thought of etiquette and law of the pre-Qin Dynasty, but also a way to design and prospect the social ideal of achieving lasting peace and stability in the Han Dynasty, in which there are some reasonable elements. It is worth learning from today's people. The author thinks that Jia Yi has institutionalized the thought of etiquette and law of the pre-Qin scholars, especially the pre-Qin Confucianism, which is the outstanding contribution of Jia Yi's concept of etiquette and law. Secondly, Jia Yi emphasizes the value and significance of the comprehensive management of "the confluence of etiquette and law" in realizing the social order, which has important enlightening significance to the construction of harmonious society in contemporary China. Although these thoughts of Jia Yi could not be turned into reality because of the restrictions of various conditions in the Han Dynasty, the profound influence of his concept of etiquette and law on later generations is an undeniable historical fact. Therefore, this paper probes into Jia Yi's concept of etiquette and law from four aspects. The first chapter discusses the historical conditions and theoretical basis for the formation of Jia Yi's concept of "etiquette and law", the second chapter focuses on the system composition of Jia Yi's "rite and law" view, the third chapter compares Jia Yi's concept with that of Kong, Meng and Xun's; Chapter four discusses the historical influence and contemporary enlightenment of Jia Yi's concept of Rite Law.
