论我国地方立法过程中利益表达机制的完善

【摘要】： 本文研究的是我国地方立法过程中利益表达机制的完善这样一个兼具理论和实践意义的问题,旨在探索能够完善我国地方立法过程中利益表达机制的理论支撑和制度构想。基本框架由导论、正文、结语三部分组成。导论中首先对本文的研究范围进行了界定,即以我国的地方立法作为讨论范围,以利益表达机制为研究对象;其次是研究的缘起,对该问题进行思索和研究是缘于对我国地方立法过程民主化的关注;第三是介绍了本文的研究方法,主要是实证的、描述的方法。结语中重申了地方立法过程中公众利益表达的重要意义及需要解决的关键问题,同时对我国地方立法过程中形成一个均衡、竞争的“立法市场”之未来进行了展望及笔者本人的期望。 正文部分共分三章内容。第一章分析了地方立法过程中利益表达的基本理论,主要涉及地方立法中利益表达的内涵和特征、完善地方立法过程中利益表达机制的价值意义和功能期待、完善我国地方立法过程中利益表达机制的必要性与可能性以及公众参与立法过程表达利益诉求的理论基础,诸如立法与公意、现代民主理论等等。第二章是对当前我国地方立法过程中利益表达制度实践的现状进行描述和实证分析,重点描述的是立法草案公开征求意见和立法听证两种制度,并以《广州市养犬管理规定》作为个案描述我国地方立法过程中的草案公开征求意见、以2006年北京市政府规章立法听证会为考察样本分析地方立法听证制度的运作过程。第三章指出了今后完善我国地方立法过程中利益表达机制所需解决的问题并提出相应的对策与思路,重点是积极培育中国的非政府组织,提高其自主性、完善地方立法过程中的正当程序、及网络技术资源的合理运用和归责、救济机制的建立等内容。 本论文主要采用了实证、描述的方法,从政治学、社会学、法学等多种视角来审视我国地方立法过程中利益表达这样一个法学理论及法学实践问题,以理论为向导,通过对实践的剖析,提出完善我国地方立法过程中利益表达机制的对策与思路。
[Abstract]:This paper studies the perfection of the mechanism of interest expression in the process of local legislation of our country, which has both theoretical and practical significance, in order to explore the theoretical support and institutional conception that can perfect the mechanism of interest expression in the process of local legislation in China. The basic framework consists of three parts: introduction, text and conclusion. In the introduction, the research scope of this paper is defined, that is, taking the local legislation of our country as the scope of discussion and the mechanism of interest expression as the research object; The second is the origin of the study, the thinking and research on this issue is due to the democratization of the local legislative process in China; the third is to introduce the research methods of this paper, mainly empirical, descriptive methods. The conclusion reaffirms the importance of the expression of public interest in the process of local legislation and the key issues to be solved, and at the same time forms a balance in the process of local legislation in China. The future of the competitive "legislative market" is prospected and the author's expectation is given. The main body is divided into three chapters. The first chapter analyzes the basic theory of interest expression in the process of local legislation, mainly involving the connotation and characteristics of interest expression in local legislation, and perfecting the value significance and functional expectation of the mechanism of interest expression in the process of local legislation. The necessity and possibility of perfecting the mechanism of interest expression in the process of local legislation, as well as the theoretical basis of public participation in the process of expressing interest demands, such as legislation and public will, modern democratic theory, and so on. The second chapter describes and empirically analyzes the current situation of the practice of interest expression system in the process of local legislation in China, focusing on the two systems of public solicitation of opinions and legislative hearing of the draft legislation. As a case study, the paper describes the draft of the local legislation process in China for public comments, and takes the 2006 Beijing Municipal Government Regulation Legislative hearing as a sample to analyze the operation process of the local legislative hearing system. The third chapter points out the problems that need to be solved to improve the mechanism of interest expression in the process of local legislation in China in the future, and puts forward the corresponding countermeasures and ideas, focusing on the active cultivation of non-governmental organizations in China and the improvement of their autonomy. Perfect due process in the process of local legislation, reasonable use and imputation of network technical resources, establishment of relief mechanism and so on. This paper mainly adopts empirical and descriptive methods to examine the legal theory and practice of interest expression in the process of local legislation from the perspectives of political science, sociology, law and so on, and takes the theory as the guide. Through the analysis of practice, this paper puts forward the countermeasures and ideas to perfect the mechanism of interest expression in the process of local legislation in China.
