从系统功能语言学看汉语立法语篇的权威性

　　法律的制定、解释和实施是所有社会必不可少的。语言是实现这些法律过程的基本手段。因此,法律以及法律语言都成为社会生活的一部分。法律语篇,无论是书面语篇还是口头语篇,已成为语言学研究的一个焦点。权力在语言运用中无所不在,权力的表达和重塑需要通过语言来实现。法律语言这个独特的语言变体,不论是口头语还是书面语,在语言表达上体现了法律权力。法律权力是指一个国家在制定和修改法律时的权力。事实上在法律语篇中法律权力表现为法律权威性,它是法律语篇固有的性质。本文从系统功能语言学出发,通过对中华人民共和国宪法这一立法语篇的分析,试图揭示该语篇中蕴涵的法律权威性,期望通过此分析提高人们的法律语言意识,并能有助于提高法律语言的表达水平。本论文共分五章。第一章是导论。首先是对法律语言学研究现状的概述,然后介绍了本论文的理论基础、目标、方法以及语料的选取,并提出了中华人民共和国宪法这一立法语篇的权威性是如何产生的,同时又是怎样在该语篇中得到体现的这两个贯穿全文的研究问题。第二章是与本论文研究有关的文献综述。本章第一节综述了语篇和权力的关系,指出在法律语篇中法律权力表现为法律的权威性。第二节通过国内外对立法语篇的...
