对我国人民陪审员制度的分析与反思

【摘要】：陪审制度的历史源远流长,但是在中国,人民陪审员制度从初具雏形到如今,也才几十年。陪审制度在实施过程中也不可避免的与我国的司法现状、法律文化产生了缝隙。随着社会的不断进步,司法改革的深化,民众法律意识的不断提高,我国的人民陪审员制度也面临着何去何从的改革困境。本文以人民陪审员制度为研究对象,对我国的人民陪审员制度进行了解读剖析,针对人民陪审员制度现有的施行状况和我国国情,结合普通法系陪审制和大陆法系参审制的特点,提出了改革的建议,旨在通过改革来促使人民陪审制度功能的有效发挥,从而治疗现有司法制度中的问题。全文在上述思路的指引下,分为五个章节:第一章为“人民陪审制度概述”,明确了陪审制度的内涵和特征。第二章为“我国人民陪审制度的发展历程”,讲述了人民陪审员制度的起源和发展过程。第三章为“国外陪审制度的考察及借鉴”,通过对国外两大法系的陪审制度进行介绍和比较分析,从而提出对我国陪审制的借鉴意义;第四章为“我国人民陪审制度的实证分析”,以案例形式进行实证研究,通过对江西省九江县人民陪审员制度的实施情况进行介绍与分析,引出我国现行的人民陪审员制度所存在的不足之处。第五章为“对我国人民陪审制度的完善建议”,在上一章节提出问题的基础上,提出了相应的对策,期望进一步在宪法中明确人民陪审员制度的地位,使其成为一项公民能够真正行使的权利。同时,改善陪审员的遴选过程和合理界定适用陪审制的范围,强调了人民陪审员应当发挥的作用,并在程序上做出一系列规定,保障公民权利的实施和陪审员作用的发挥。人民陪审员制度的发展改革道路必定任重而道远,陪审制度的突破和新生,需要理论和实务界共同努力开拓。
[Abstract]:The jury system has a long history, but in China, the people's jury system from its embryonic form to now, is only several ten years. The jury system in the implementation process is inevitable and the judicial status quo of our country. With the development of the society, the deepening of the judicial reform, the legal consciousness of the public has been improved. The people's jury system in our country is also facing the dilemma of reform. This paper takes the people's jury system as the research object, and analyzes the people's jury system of our country. According to the current implementation of the people's jury system and the national conditions of our country, combined with the common law jury system and the civil law system of the characteristics of the trial system, put forward some suggestions for reform. Through the reform to promote the effective use of the functions of the people jury system, so as to cure the problems in the existing judicial system. It is divided into five chapters: the first chapter is an overview of the people's jury system, which clarifies the connotation and characteristics of the jury system, and the second chapter is "the development process of the people's jury system in China". The third chapter is "the investigation and reference of foreign jury system", through the introduction and comparative analysis of the jury system of the two major legal systems of foreign countries. Therefore, the paper puts forward the significance of reference to the jury system in our country. Chapter 4th is "the empirical analysis of the people's jury system in China", through the introduction and analysis of the implementation of the people's jury system in Jiujiang County, Jiangxi Province. Chapter 5th is "suggestions on the perfection of the people's jury system in China", which puts forward the corresponding countermeasures on the basis of the problems raised in the previous chapter. It is expected to further clarify the status of the people's jury system in the Constitution so as to make it a right that citizens can really exercise. At the same time, improve the selection process of jurors and rationally define the scope of application of the jury system. It emphasizes the role that the people's jurors should play, and makes a series of provisions in the procedure to ensure the implementation of civil rights and the role of jurors. The development and reform of the people's jury system must have a long way to go. The breakthrough and renewal of jury system need the joint efforts of theoretical and practical circles.
