【摘要】：20世纪初期我国曾经进行过主诉检察官办案责任制改革。党的十八大之后,检察官办案责任制改革再次成为司法改革的重要内容。两次改革均未达到预期目的,究其原因是为我国政策实施型司法模式所限制。政策实施型司法与科层体制具有高度的契合性。而行政审批制办案模式则满足了政策实施型司法权力集中与质量控制方面的需要。因此,两次改革都不可能从根本上放弃行政审批制办案模式。面对办案责任的压力,我国检察官办案责任制改革则通过部分权力让渡与责任范围划分的方式予以化解,但这均非根本的解决之道。未来的检察官办案责任制改革需要在转变政策实施型司法模式的基础上,疏离政策实施型司法与行政审批制之间的紧密关系,构建起检察一体与检察官独立相协调的办案机制。
[Abstract]:In the beginning of 20th century, China once carried out the reform of the responsibility system for handling cases of chief prosecution prosecutors. In the future, the reform of the procurator case responsibility system needs to shift the policy implementation of the judicial model, alienate the close relationship between the policy implementation of the judiciary and the administrative examination and approval system.
