从道德责任到职业伦理——法官责任的道德性

【摘要】：人们通常认为,相比于其他职业而言,法官应当负有更高的道德责任,但是,这个观念的确切意义仍有待探究,因为无论是法官责任还是道德责任,都存在多重的面向。事实上,法官高阶道德责任的核心,并不在于尽量避免错误以免受追责,而是在于对法律命题作出最佳的道德证立,法官应摆脱"平庸之恶",矢志追求司法的卓越品质。这意味着对法官责任的认定和规范,应当实现从法官责任向法官职业伦理的转变。
[Abstract]:It is generally believed that judges should have a higher moral responsibility than in other professions, but the exact meaning of this concept remains to be explored, both in terms of judge responsibility and moral responsibility. In fact, the core of the high moral responsibility of judges is not to avoid mistakes to avoid liability, but to make the best moral proof of legal proposition. Judges should get rid of the "mediocre evil" and pursue the outstanding quality of the judicature, which means that the judge's responsibility should be recognized and standardized, and the transformation from the judge's responsibility to the judge's professional ethics should be realized.
