刑事司法鉴定法律援助制度研究

【摘要】：在现实生活中,由于人们的经济条件不一,常出现涉诉当事人因无力缴纳鉴定费用而无法行使法律规定的对鉴定结论的质疑权的现象。然而,司法鉴定法律援助制度的出现在某种程度上解决了这一问题。这一制度是对“穷人”实施的一种法律救助制度,目的是为了实现司法公正,实现“法律面前人人平等”。但由于这一制度在我国兴起的时间不长,理论研究和工作实践中还或多或少存在一些问题。鉴于此,本文以刑事司法鉴定法律援助作为研究主题,分四章介绍了这一制度。第一章主要从刑事司法鉴定法律援助制度的概念、特征、理论基础等方面论述了这一制度的基本理论,明确了刑事司法鉴定法律援助是法律援助制度的重要组成部分;第二章主要对刑事司法鉴定法律援助制度在我国存在的必要性和可行性进行了分析;第三章主要从刑事司法鉴定法律援助工作取得的成绩及面临的困难两大方面阐述了我国刑事司法鉴定法律援助工作开展的情况;第四章是在前三章论述的基础上预测了刑事司法鉴定法律援助制度在我国的发展趋势,同时还对该制度在运行过程中存在的问题提出了解决措施。刑事司法鉴定法律援助制度在我国才刚刚起步,其发展还面临着很多困难:到目前为止,我国还没有一部统一的有关司法鉴定法律援助制度的法律,援助经费短缺、援助质量不高等问题影响着这一制度功能的发挥。为此,笔者认为,应当加强司法鉴定法律援助的立法工作,早日制定一部完整统一的有关司法鉴定援助制度的法律;加大对贫困地区援助资金的投入,以便鉴定援助制度在全社会普及;同时还应扩宽鉴定援助资金的来源渠道,为鉴定援助工作的开展提供物质保障;最后,还应加强对鉴定援助案件的质量监管,切实保障受援人的合法权益。总之,我国的司法鉴定法律援助制度还存在许多亟需解决的问题,迫切需要我们采取措施加以完善。
[Abstract]:In real life, due to the different economic conditions of people, the litigants are often unable to exercise the legal right to challenge the conclusion because they are unable to pay the identification fees. However, The emergence of the system of forensic legal aid has solved this problem to some extent. This system is a system of legal aid for the "poor" in order to achieve justice. The realization of "equality before the law". However, there are still some problems in the theoretical research and work practice because this system has not been emerging for a long time in our country. In view of this, this paper takes the legal aid of criminal judicial expertise as the research topic. The first chapter mainly discusses the basic theory of this system from the aspects of the concept, characteristics and theoretical basis of the legal aid system of criminal judicial identification. It is clear that legal aid of criminal judicial identification is an important part of the legal aid system, the second chapter mainly analyzes the necessity and feasibility of the legal aid system of criminal judicial identification in our country. The third chapter mainly from the criminal judicial identification legal aid work achievement and faces the difficulty two big aspects elaborated our country criminal judicial appraisal legal aid work to carry out the situation; Chapter 4th predicts the development trend of the legal aid system of criminal judicial identification in China on the basis of the first three chapters. At the same time, it also puts forward some solutions to the problems existing in the operation of the system. The legal aid system of criminal judicial identification is just beginning in our country, and its development is still faced with many difficulties: up to now, There is no uniform law on the legal aid system of judicial expertise in our country. The shortage of aid funds and the low quality of aid affect the function of this system. We should strengthen the legislative work of judicial expertise legal aid, formulate a complete and unified law on judicial expertise aid system as soon as possible, increase the investment of aid funds in poor areas, so as to popularize the appraisal aid system in the whole society; At the same time, the sources of identification assistance funds should be broadened to provide material protection for the development of the identification assistance work. Finally, the quality control of identification assistance cases should be strengthened to ensure the legitimate rights and interests of the recipients. There are still many problems that need to be solved in the system of forensic legal aid in our country, and it is urgent for us to take measures to perfect it.
