论民事判决书的说理性

【摘要】： 本文就我国民事判决书的说理性的若干全局性、前瞻性问题进行了系统探讨和对比分析，通过对当前法院实务中民事判决书说理性方面的改革提一些建议，以引发法官同仁的思考。判决书是公正司法与法院文明之载体；判决书的是否说理，则是判决书是否具有公信力和权威性的根本特征。从我国法治进程角度出发，从民事判决书与其他相关文书的比较来看，民事判决书尤其要求说理。同时，为促进民事判决书说理的改进，，在司法实践中应强化法官对法律规范的解释权，民事判决理由部分对情理、事理的阐述可以考虑将非正式法律渊源作为民事判决说理的依据；判决说理中除应运用好语言与逻辑之外，可考虑写作“法官后语”。同时，应将法条原文写进判决书中。而裁判文书中对法院内部不同意见的可以进行记载，以增加判决书的说理成分。民事判决书的说理还应结合中国传统文化，注重对人情、事理的论述。
[Abstract]:This paper makes a systematic discussion and comparative analysis on the overall and forward-looking aspects of the rationality of the civil judgment in our country, and puts forward some suggestions on the reform of the theory of rationality in the civil judgment in the current court practice. The judgment is the carrier of justice and the civilization of the court. Whether the judgment is reasonable or not is the fundamental characteristic of whether the judgment has credibility and authority. From the point of view of the process of rule of law in our country, the judgment is the carrier of justice and the civilization of the court. From the comparison of civil judgment and other relevant documents, civil judgment especially requires reasoning. At the same time, in order to promote the improvement of civil judgment reasoning, judges' power of interpretation of legal norms should be strengthened in judicial practice. The reason of civil judgment is partly to reason, the elaboration of reason may consider the informal legal origin as the basis of civil judgment reasoning. Besides the use of language and logic in judgment reasoning, we may consider writing "the latter language". The original text of the law should be written into the judgment. However, in the judgment document, the dissenting opinions within the court can be recorded in order to increase the reasoning elements of the judgment. The reasoning of the civil judgment should also be combined with the traditional Chinese culture and pay attention to human feelings. A reasoned statement.
