美国社区检察制度的运作模式与启示

【摘要】：正美国是联邦制国家,实行立法权、行政权和司法权三权分立的政治制度,检察权隶属于行政权,检察机关是司法部门的内设机构,总检察长由司法部长兼任。美国的检察机关并不具有法律监督职能,仅仅作为公诉权与侦查权的结合体而存在,主要对警察的刑事侦查过程进行指挥、以公益代表人的身份对刑事犯罪提起公诉。
[Abstract]:The United States is a federal country with a political system in which legislative, executive and judicial powers are separated, procuratorial power is subordinate to executive power, and procuratorial organs are internal organs of the judiciary. The Attorney General is also appointed by the Attorney General. The procuratorial organs in the United States do not have the function of legal supervision, but only exist as a combination of the power of public prosecution and the power of investigation. They mainly direct the criminal investigation process of the police. To prosecute a criminal offence as a representative of the public interest.
