【摘要】：以《威斯特伐利亚和约》的缔结为标志而产生的具有独立体系的国际法,经过20世纪,特别是最近70年的快速发展,已由"共存"国际法的传统一元结构发展为由"共存"国际法、"合作"国际法和"人权"国际法构成的现代三元结构。联合国作为国际法形成与实施可资依附的最权威的普遍性国际组织,不仅在其宪法性文件——《联合国宪章》中确立了"共存"国际法、"合作"国际法和"人权"国际法的体系性存在,而且在其成立之后的70年中,为它们的发展作出了不懈的法律努力。考察和分析联合国在国际法结构的现代变迁中发挥的作用,既是对联合国成立70周年的一种纪念,也有助于认识和把握国际法发展的特点和规律。
