跨国公司的环境保护责任及其法律规制

【摘要】：在经济全球化的背景下，，跨国公司作为一支重要的经济力量登上了世界舞台，并创造了巨大的经济利益。随着一些发达国家逐步提高本国的环境标准，加强本国环境监管，一些跨国公司开始将污染型企业转移至环境标准较低、相关立法制度不完善的发展中国家，对自身的环境保护责任不加以履行，给包括我国在内的发展中国家的环境造成了不少问题。基于这种严峻的环境形势，对跨国公司的环境保护责任的法律规制问题进行研究具有重要意义和价值。本文在对跨国公司的环境保护责任的基本概念进行界定的基础上阐述和研究了当今世界范围内国际法和国内法对跨国公司环境保护责任规制的状况，并指出在对其进行法律规制过程中存在的问题和障碍。通过这些分析，最后对跨国公司环境保护责任的国际法规制提出一些构想，并进一步提出对于完善我国相关制度的建议。
[Abstract]:Under the background of economic globalization, multinational corporations, as an important economic force, have stepped onto the world stage and created huge economic benefits. As some developed countries gradually improve their own environmental standards. To strengthen domestic environmental regulation, some multinational corporations began to transfer pollution-type enterprises to developing countries with low environmental standards and imperfect relevant legislative systems, and did not carry out their own environmental protection responsibilities. It has caused a lot of problems to the environment of developing countries including China. Based on this grim environmental situation. It is of great significance and value to study the legal regulation of the environmental protection responsibility of transnational corporations. Based on the definition of the basic concept of environmental protection responsibility of transnational corporations, this paper expounds and studies the present world. The international law and domestic law in the scope of the transnational corporation environmental protection responsibility regulation status. And points out the existing problems and obstacles in the process of its legal regulation. Through these analysis, finally put forward some ideas on the international legal regulation of the responsibility of environmental protection of transnational corporations. And further put forward for the improvement of the relevant system of China's recommendations.
