版权技术保护措施信息安全遵从模式比较分析——以美国和德国为主要研究对象

【摘要】：不完善的版权技术保护措施使得使用者信息安全面临风险。为有效防范和规制版权技术保护措施所带来的信息安全风险,版权技术保护措施的信息安全遵从义务被关注,而美国和德国对此采取了不同的实践模式。比较两国信息安全遵从模式显示,美国版权立法的反规避条款例外规定是规制技术保护措施信息安全风险的主要模式,而德国赋予版权人强制的独立义务适应了数字时代版权技术保护措施安全应用的需求,也显示了完善版权技术保护措施法律规制制度的立法趋势。鉴于版权技术保护措施信息安全遵从的必要,美国和德国对版权技术保护措施信息安全遵从模式的比较分析对于我国版权立法中引入强制的信息安全遵从义务,协调版权技术保护措施与信息安全紧张关系提供了有益借鉴。
[Abstract]:Imperfect copyright technology protection measures make users' information security face risks. In order to effectively prevent and regulate the copyright technology protection measures brought information security risks. The obligation of information security compliance of copyright technology protection measures is concerned, but the United States and Germany have adopted different practice models to this. The comparison between the two countries information security compliance mode shows. The exception of anti-circumvention clause in American copyright legislation is the main mode of regulating the information security risk of technical protection measures. And the independent obligation that Germany bestows on copyright holders meets the demand of the security application of copyright technology protection measures in the digital age. It also shows the legislative trend of perfecting the legal regulation system of copyright technology protection measures. In view of the necessity of information security compliance of copyright technology protection measures. Comparative Analysis of Information Security Compliance models of copyright Technology Protection measures in USA and Germany; mandatory information security compliance obligations are introduced into Chinese copyright legislation. Coordination of copyright technology protection measures and information security tension provides a useful reference.
