环保NGO参与公共环境安全事件应对研究

【摘要】：近年来,我国的环境形势越发严峻,公共环境安全事件的总量不断上升,对人类的公共环境安全造成了极大的威胁。政府作为公共环境安全事件的应对主体,其主导地位无可替代。但由于当前环境领域存在着政府失灵的弊端,单纯依靠政府已经无法完全应对当前的环境形势。我国环保NGO作为新兴力量,已经具备了环境事件参与应对的能力,它作为协同治理主体之一,能够弥补政府在公共环境安全事件中参与主体单一性不足,同时还能监督政府履行环保职责,为政府与公众之间搭建信息交流的平台,提高环境事件的应对能力。目前中国的环保NGO参与公共环境安全事件主要借助于参与影响政府立法决策议程、对破坏环境的行为提起公益诉讼等方式来进行。本文采用个案研究法,选取公共环境安全事件的典型案例进行分析,明确其在参与过程中存在着知识专业性不足、参与手段单一、缺乏事前参与及政策参与形式化、独立性不足、资金缺乏、公众不支持等一系列问题,进一步分析得出其主要原因在于环保NGO组织专业人员较少、政府参与程序保障不足以及政府在环保NGO的登记注册、资金支持、法律诉讼等方面配套制度不完善、公众环保意识较低。接着采用经验借鉴法,在借鉴国外典型国家环保NGO参与应对公共环境安全事件经验的基础上,提出对完善我国环保NGO参与应对公共环境安全事件的对策建议。文章的主体结构分为六个部分,第三至第六部分则为论文的主干部分。第三部分主要介绍了当前我国公共环境安全事件应对现状及不足。第四部分则主要介绍了我国环保NGO参与公共环境安全事件应对及问题,对其在参与应对中的问题,则通过选取公共环境安全事件典型案例加以分析,进而明确其原因。第五部分则介绍了国外典型国家环保NGO参与应对公共环境安全事件的经验,从中得到启示。最后一部分则是提出对完善我国环保NGO参与应对公共环境安全事件的对策建议。
[Abstract]:In recent years, China's environmental situation is more severe, the total amount of public environmental safety events continue to rise, threaten the public security environment of human beings. The government as a response to the main event of public environmental safety, its leading status is irreplaceable. But due to the current environment there are drawbacks of government failure, the government has been unable to rely on complete response to the current environmental situation of China's environmental protection. NGO as a new force, have the ability to participate in response to environmental events, it is one of the main body of collaborative governance, can make up for the government in the event of public participation in environmental safety of single main defects, but also supervise the government implementation of environmental responsibilities, set up information exchange between the government and the public the platform, improve the environmental emergency response capacity. At present Chinese environmental NGO in the event of public environmental safety mainly depend on the participation. Sound agenda for government legislative decision, for acts of destruction of the environment public interest litigation etc. This paper adopts the method of case study, analyzes the typical case selection events of public environmental safety, clarify its participation in the process of insufficient professional knowledge, participation means a single, lack of participation and advance policy in the formal independence lack of funds, lack of public support, a series of problems, further analysis shows that the main reason is that environmental protection NGO professional organizations involved in the program is less, inadequate protection and the government in environmental protection NGO registered capital in support of the government, legal and other aspects of supporting system is not perfect, the public awareness of environmental protection is low. Then using the experience method on the basis of typical foreign countries, environmental protection NGO in dealing with the public environmental safety event experience, put forward to improve the environmental NGO in China in response to the public Suggestions were environmental security incidents. The main structure of this paper is divided into six parts, third to the sixth part is the main part of the paper. The third part mainly introduces the current situation of public security incident response and environment in our country. The fourth part mainly introduces the environmental NGO in China to participate in the public security incident response and environmental problems for, in dealing with the problems in the selection of public environmental safety incidents through typical case analysis, and then clear the reason. The fifth part introduces the foreign typical national environmental NGO in dealing with the public environmental safety event experience, get inspiration. The last part is put forward suggestions and countermeasures to improve the environmental protection NGO our country in dealing with the public environmental security incidents.
