【摘要】：情况复杂、一直备受争议的国际商事仲裁法律适用问题包含两个方面：实体法的适用与程序法的适用。而其中关于仲裁程序的法律适用问题一直是国际商事仲裁领域中学者们意见最难以统一的一个论题。国际上对于仲裁程序可以适用的法律有哪些以及如何选择仲裁程序法一直没有统一的定论。当事人可基于意思自治选择仲裁程序法,这一原则在一些国家仲裁程序法的选择上得到了体现。各个国家对这种选择权都有不同程度的限制,但限制条件也各不相同。能否处理好仲裁程序的法律适用问题对一个国家来说具有重要意义。从宏观上看事关一国的仲裁立法如何定位；从微观上讲,则关系到能否快速、高效的解决争议以及争议的结果是否公正。并且,若要增加国际商事仲裁机构对当事人的吸引力,就一定要在该问题上下功夫。探讨国际商事仲裁程序的法律适用,以此为基础,进一步研究我国仲裁程序的法律适用制度,且结合当前我国仲裁程序法律适用过程中所出现的问题,提出改进与完善的建议。
[Abstract]:The situation is complex, has been a controversial issue of the applicable law of international commercial arbitration includes two aspects: the applicable substantive law and procedural law. And the applicable law of the arbitration procedures has been a topic of international commercial arbitration in the field of scholars' views of the most difficult to unity. For international arbitration procedure can apply the law what and how to choose the procedure of the arbitration law has no unified conclusion. The parties can choose the autonomy of arbitration law based on this principle has been reflected in some countries in the arbitration law choice. Different countries have different degrees of restrictions on the right to choose, but the restrictions are not the same. Can handle good laws applicable to the arbitration procedure for a country to have the important meaning. See how to position it is related to a country's arbitration legislation from the macro from the micro; Speaking, is related to the ability to fast and efficient settlement of disputes and the dispute whether the results of justice. And, if you want to increase the attractiveness of the international commercial arbitration organization, it must be on the issue of efforts. To explore the application of international commercial arbitration law, on the basis of law applicable to further study of the system of arbitration in China the program, and combined with the current China's arbitration law problems in the process of application, put forward suggestions for improvement and perfection.
