我国应对绿色贸易壁垒的相关法律研究

【摘要】：随着经济全球化浪潮的发展与我国入世10年来经济的发展，国际间的交流与合作成为必不可少的一部分，我们在欣喜入世带给我们经济巨大发展的同时也看到了在全球经济合作这个大熔炉里，我们还是一直受到绿色壁垒的影响。在绿色贸易壁垒的影响下，我国出口产品由于达不到一些发达国家的环保技术要求被迫退出市场，即使国内一些企业勉强符合了标准也因生产成本的增加而失去竞争力，同时我国对进口产品的低标准、低要求造成了一些国家的劣质产品流入，给我国环境和人民身体健康带来严重的危害以及潜在的威胁。从20世纪80年代绿色壁垒的出现到20世纪90年代的初步形成，绿色贸易壁垒受到了全球的关注，以国际法做为绿色壁垒产生的法律基础，国际上现在已有大量的有关保护环境和促进贸易的国际条约，其中以《里约宣言》、《21世纪议程》以及约翰内斯堡会议通过的《执行计划》、《宣言》和WTO等为代表，其为国家间解决环境与贸易的冲突提供了法律支撑。我国在《环境保护法》基础上还制定了各种关于绿色贸易壁垒的法律法规，但这些条约与政策的研究与出现还是远远不够的，作为全球最大的发展中国家的我国也一直受到这一壁垒限制的困扰。本文拟从环境保护的角度来对国际贸易中的绿色贸易壁垒问题进行研究，主要分为五个章节：第一章引言在这一部分中主要介绍本课题的研究背景、研究概况及研究意义。第二章从绿色贸易壁垒的概念入手，对绿色贸易壁垒进行概述分析，，对其概念特点、成因、表现形式进行分析与探讨并指出绿色贸易壁垒对我国进出口的影响。第三章主要阐述国际上的关于绿色贸易壁垒的条约及世界主要发达国家的绿色壁垒相关法律规定，分析国外绿色贸易壁垒立法的先进经验，为我国相关法律制度的完善打下基础。第四章主要阐述了我国关于绿色壁垒的立法现状与不足，指出我国完善绿色贸易壁垒的必要性。第五章完善我国绿色贸易壁垒的相关法律制度，针对我国的立法现状提出些建设性的建议，力求能得到改善。结语总结论文的主要内容及其不足，希望可以完善我国绿色贸易壁垒法律制度框架。
[Abstract]:With the development of economic globalization and the economic development of China's entry into WTO for 10 years, international exchanges and cooperation have become an indispensable part. At the same time, we also see that in the melting pot of global economic cooperation, we are still affected by green barriers. Under the influence of green trade barriers. China's export products are forced to withdraw from the market because they can not meet the environmental protection technology requirements of some developed countries. Even if some domestic enterprises barely meet the standard, they also lose their competitiveness because of the increase in production costs. At the same time, the low standards and low requirements of imported products in China have caused the inflow of inferior products in some countries, which has brought serious harm and potential threat to our environment and people's health. From the appearance of green barriers in 1980s to the initial formation in 1990s, green trade barriers have received global attention, with international law as the legal basis for the emergence of green barriers. There are a large number of international treaties on the protection of the environment and the promotion of trade, including the Rio Declaration, the agenda of 21th century and the Plan of implementation adopted at the Johannesburg Conference. "Declaration" and "WTO" are the representatives, which provide legal support for solving the conflict between environment and trade among countries. On the basis of "Environmental Protection Law", China has also formulated various laws and regulations on green trade barriers. However, the research and appearance of these treaties and policies is far from enough. As the largest developing country in the world, China has always been troubled by this barrier. This paper intends to study the green trade barriers in international trade from the perspective of environmental protection, which is divided into five chapters: The first chapter introduces the background, research situation and significance of the research in this part. The second chapter starts with the concept of green trade barriers, analyzes the green trade barriers, its concept characteristics, causes. This paper analyzes and discusses the influence of green trade barriers on China's import and export. The third chapter mainly expounds the international treaties on green trade barriers and the relevant laws and regulations of the world's major developed countries, and analyzes the advanced experience of foreign countries in the legislation of green trade barriers. It will lay the foundation for the perfection of the relevant legal system in our country. Chapter 4th mainly expounds the current situation and deficiency of legislation on green trade barrier in China, and points out the necessity of perfecting green trade barrier in our country. Chapter 5th consummates the related legal system of green trade barrier of our country, and puts forward some constructive suggestions in view of the present situation of our country's legislation, and tries to improve it. The conclusion summarizes the main contents and shortcomings of the thesis, hoping to perfect the legal framework of green trade barriers in China.
