【摘要】：欧洲理事会的经济和社会权利的集体申诉制度是任择的,自1998年建立以来富有成效地运转着。在这一申诉机制中,欧洲社会权利委员会处于核心地位,其审查程序公平、公正。欧洲理事会部长委员会对欧洲社会权利委员的报告的审议是程序性的,因其最后决议或建议对被申诉缔约国不具有法律约束力,导致效果的不均衡。申诉案件涉及的条款较为集中。这一制度是各缔约国经济和社会权利国内救济机制在国际法上的延伸,是国际人权理论和实践发展的结果,并将进一步推动经济和社会权利的国际救济机制的发展。
[Abstract]:The Council of Europe's collective complaints system on economic and social rights is optional and has functioned productively since its establishment in 1998. In this complaints mechanism, the European Commission on Social Rights is at the centre of the system and its review procedure is fair, Impartiality. The consideration by the Committee of Ministers of the Council of Europe of the report of the European Committee of Social Rights is procedural, as its final resolutions or recommendations are not legally binding on the State party complained of, This system is an extension of the domestic remedies mechanism of the economic and social rights of States parties in international law and is the result of the development of international human rights theory and practice, And will further promote the economic and social rights of the international relief mechanism development.
