跨国租购中民用航空器适航责任研究

【摘要】：适航制度发挥着保障民用航空器安全性的重要作用,适航责任制度更是处理不适航的民用航空器所造成的各项损失及社会影响的依据。由于各个国家对于民用航空器适航责任的判定标准有所不同,因此跨国租购中民用航空器适航责任不同于单纯的国内租购航空器适航责任。跨国租购民用航空器适航责任制度的适航标准是否国际化、适航责任制度是否符合我国航空业发展需求、对适航主体的责任界定等因素都将对我国跨国租购民用航空器适航责任的有效判定产生影响。我国的跨国航空器租购适航制度存在较多问题。在面对跨国租购民用航空器适航纠纷等问题时,我国对国际适航标准本土化不足,只能借助美国或欧洲的适航标准,并未结合我国航空业发展的实际情况,适航制度缺乏适航责任制度。针对这些问题,必须要借鉴国际发达国家的先进经验,制定符合我国航空业发展需求的适航责任制度,并随着时代发展不断完善更新跨国租购民用航空器适航责任制度。论文分为四章,第一章分析了跨国租购民用航空器适航制度研究现状,讨论了适航责任制度的实践与理论意义。第二章研究了适航责任的理论基础,明晰了其与产品责任之关联关系。第三章比较了中美欧适航责任制度之异同,提出我国可资借鉴之适当制度与理论。第四章研究了中国跨国租购情况下的适航制度存在的问题及其解决路径。
[Abstract]:The airworthiness system plays an important role in ensuring the safety of civil aircraft. The airworthiness liability system is also the basis for dealing with the loss and social impact caused by unseaworthy civil aircraft. As the criteria for determining the liability for airworthiness of civil aircraft vary from country to country, Therefore, the airworthiness liability of civil aircraft in transnational hire purchase is different from that of domestic charter purchase aircraft. Is the airworthiness standard of the liability system of airworthiness for transnational hire purchase civil aircraft internationalized? Whether the liability system for airworthiness meets the needs of the development of the aviation industry in China, The definition of liability of the airworthiness subject will have an impact on the effective determination of the airworthiness liability of our country's transnational chartered aircraft. There are many problems in our country's multinational aircraft leasing and purchasing seaworthiness system. When using aircraft for airworthiness disputes and other issues, Our country has insufficient localization of international airworthiness standards, and can only rely on the airworthiness standards of the United States or Europe, without considering the actual situation of the development of the aviation industry in our country, and the airworthiness system lacks a liability system for airworthiness. It is necessary to draw lessons from the advanced experience of the developed countries and formulate a seaworthy liability system that meets the needs of the development of China's aviation industry, and with the development of the times, we must constantly improve and update the seaworthy liability system of transnational leased and purchased civil aircraft. This paper is divided into four chapters. The first chapter analyzes the present situation of the research on the seaworthiness system of transnational leased aircraft, and discusses the practical and theoretical significance of the seaworthiness liability system. The second chapter studies the theoretical basis of the seaworthiness liability. The third chapter compares the similarities and differences of the airworthiness liability system between China and Europe. Chapter 4th studies the problems and solutions of the seaworthiness system in the case of transnational leasing purchase in China.
