【摘要】：海洋及其资源在维持地球上的生命方面发挥关键作用,并提供造福于人类的商品和服务。伴随着海洋科学研究、勘探技术的发展及深海海床矿物资源的勘察进程,发现并明确了国际海底区域极端环境下的生物多样性及其丰富的遗传资源。这些遗传资源的研究和利用,对于工业、医药、环保和军事等方面,具有十分重要的意义。然而,不论是在相关的国际法律规制还是学术研究方面均存在大量空白。国际社会还尚未确定国家管辖范围以外深海遗传资源的法律地位。本文旨对国家管辖范围以外深海遗传资源惠益分享的国际法纷争进行阐述和分析,进而对该区域遗传资源的惠益分享问题进行研究与探讨。本文分为四章:第一章对相关概念进行界定和区分。对国家管辖外区域进行了界定,对国家管辖外深海遗传资源的概念和特征进行了阐述,同时对国家管辖外遗传资源的惠益分享的概念进行了简要界定。第二章对国家管辖外深海遗传资源惠益分享的国际法依据进行了分析,阐述了国家管辖外区域深海资源惠益分享的国际法依据争议,着重对国家管辖外区域遗传资源惠益分享的国际法依据的选择进行了介绍,进而指出国家管辖外区域遗传资源惠益分享的国际法依据应为"人类共同继承财产。第三章对国家管辖外区域遗传资源惠益分享的制度选择进行了介绍,主要介绍了时下比较受推崇的知识产权制度的可适用性与惠益分享制度的可适用性。在此基础上提出笔者针对国家管辖外深海遗传资源惠益分享的完善和构想:建立以知识产权制度为基础的惠益分享制度,完善知识产权制度和惠益分享制度现有不足。第四章对结合目前BBNJ谈判的进程,对我国国际协定中惠益分享问题进行对策分析,主张将国家管辖范围外深海遗传资源作为人类共同继承财产,不断加强我国相关领域的法学研究和科研创新,建立与我国长远发展相适应的、符合全人类利益的全球海洋战略布局。
[Abstract]:The oceans and their resources play a key role in sustaining life on Earth and provide goods and services for the benefit of mankind... accompanied by marine scientific research, the development of exploration techniques and the exploration process of the mineral resources of the deep seabed, The discovery and identification of biodiversity and its rich genetic resources in extreme environments of the international seabed area. The research and utilization of these genetic resources are of great significance for industry, medicine, environmental protection and military, etc. The international community has not yet determined the legal status of deep-sea genetic resources beyond national jurisdiction. Elaboration and analysis of disputes in international law on benefit-sharing in deep-sea genetic resources, This paper is divided into four chapters: the first chapter defines and distinguishes the related concepts, and defines the areas beyond national jurisdiction. Having elaborated the concepts and characteristics of deep-sea genetic resources beyond national jurisdiction, At the same time, the concept of benefit-sharing of genetic resources beyond national jurisdiction is briefly defined. Chapter II analyses the basis of international law for benefit-sharing of deep-sea genetic resources beyond national jurisdiction, Having elaborated the dispute on the basis of international law for benefit-sharing of deep-sea resources in areas beyond national jurisdiction, and focusing on the selection of the basis of international law for benefit-sharing of genetic resources beyond national jurisdiction, Noting further that the basis of international law for benefit-sharing of genetic resources beyond national jurisdiction should be "the common heritage of mankind". Chapter III introduces the regime options for benefit-sharing of genetic resources in areas beyond national jurisdiction, This paper mainly introduces the applicability of intellectual property system and the applicability of benefit-sharing system, and puts forward the perfection and conception of benefit-sharing of deep-sea genetic resources beyond national jurisdiction. Establishing benefit-sharing systems based on intellectual property regimes, Chapter 4th analyzes the countermeasures to the problem of benefit-sharing in China's international agreements in combination with the current process of BBNJ negotiations. Advocating that deep-sea genetic resources beyond the limits of national jurisdiction be regarded as the common heritage of mankind, continuously strengthen the legal research and scientific research innovation in relevant fields of our country, and establish such resources as are suitable for the long-term development of our country, The strategic layout of the global oceans in line with the interests of all mankind.
