【摘要】:随着欧盟内部统一市场的形成,欧盟货物自由流动原则在欧盟法中凸显出其重要性,,是支撑欧洲联盟的基础性原则。在货物自由流动原则的推动下,欧盟逐步实现了货物在欧盟境内的自由贸易,并随之带动服务、资本和人员在欧盟境内的自由流动,从而巩固了欧盟内部市场。而目前,中国-东盟自由贸易区刚刚成立,欧盟货物自由流动原则在欧盟成功运行的经验对中国-东盟自由贸易区有重要的借鉴意义,学习欧盟推动货物自由流动的经验,将有利于促进中国与东盟各国之间的货物自由流动。 本文以欧盟货物自由流动原则为切入点,主要目的是探讨以下几个问题:《欧盟运行条约》第34条、第35条、第36条的适用范围?如何运用《欧盟运行条约》第34条、第35条、第36条来保障欧盟货物自由流动原则?欧盟货物自由流动原则对中国-东盟自由贸易区的启示? 本文除引言和结语外,共分成六个部分,三万四千余字。 第一部分:介绍欧盟货物自由流动原则的历史发展。分析欧盟货物自由流动原则在欧盟内部市场的地位,以及它对于扫除欧盟货物流动障碍的重要作用,并指出研究欧盟货物自由流动原则是十分必要的。 第二部分:分析欧盟关于货物自由流动的一般性规定。货物的定义、跨境交易、收货方等这些规定普遍适用于第34条、第35条以及第36条。 第三部分:分析《欧盟运行条约》第34条的内容与适用范围。第34条作为基础性条款,主要规制成员国以不正当方式限制从其他成员国进口货物的行为,其适用的范围决定了欧盟货物自由流动原则的适用范围。同时,结合欧盟法院的经典案例,对进口数量限制以及与进口数量限制有同等效果的措施、销售安排、互相认可原则以及典型的贸易壁垒进行解释和说明。 第四部分:分析《欧盟运行条约》第35条的内容与适用范围。第35条主要禁止成员国以不正当方式限制货物从一个成员国出口到其他成员国,根据欧盟案例法的发展,对第35条的解释也随之变化。 第五部分:主要分析欧盟货物自由流动原则的除外适用。这些除外适用的理由能帮助成员国合理规避《欧盟运行条约》第34条和第35条的适用。只有基于《欧盟运行条约》第36条和强制性要求这两项下的内容,才能合法排除欧盟货物自由流动原则的适用。 第六部分:欧盟货物自由流动原则对中国-东盟自由贸易区的启示。通过对欧盟货物自由流动原则的研究,进一步探讨刚成立的中国-东盟自由贸易区如何借鉴欧盟的成功经验,并就此问题提出几点建议。
[Abstract]:With the formation of the unified market within the European Union, the principle of free movement of goods in the EU law highlights its importance and is the basic principle that underpins the European Union, and is promoted by the principle of free movement of goods. The EU has gradually realized the free trade of goods within the EU, and with it the free movement of services, capital and people within the EU, thus consolidating the internal market of the EU. And at present, the China-ASEAN Free Trade area has just been established. The successful operation of the principle of free flow of goods in the EU is of great significance to the China-ASEAN Free Trade area, and learn from the experience of the EU in promoting the free flow of goods. It will facilitate the free flow of goods between China and ASEAN countries. This paper focuses on the principle of the free movement of goods in the European Union. The main purpose of this paper is to explore the following issues: the scope of application of Article 34, Article 35, Article 36 of the EU operational Treaty? How to apply Article 34, Article 35, Article 36 of the EU operational Treaty to guarantee the principle of free movement of goods in the EU? The Enlightenment of the principle of Free Movement of goods from the EU to China-ASEAN Free Trade area? In addition to the introduction and conclusion, this article is divided into six parts, more than 34,000 words. The first part introduces the historical development of the principle of free movement of goods in the European Union, analyzes the position of the principle of free movement of goods in the internal market of the European Union, and its important role in removing obstacles to the movement of goods in the European Union. It is pointed out that it is necessary to study the principle of free movement of goods in EU. Part II: analysis of the EU's general provisions on the free movement of goods. Definition of goods, cross-border transactions, recipients, etc. These provisions are generally applicable to articles 34, 35 and 36. The third part: analysis of the content and scope of application of Article 34 of the EU operational Treaty. As a basic provision, Article 34 mainly regulates the behavior of member States in restricting the import of goods from other member States in an improper manner. The scope of its application determines the scope of application of the principle of free movement of goods in the European Union. At the same time, combined with the classic case of the European Court of Justice, sales arrangements are arranged for import quantity restrictions and measures that have the same effect as import volume restrictions. Mutual acceptance principle and typical trade barriers are explained and explained. Part 4th: analysis of the content and scope of application of Article 35 of the Treaty on the Operation of the EU. Article 35 mainly prohibits member States from unduly restricting the export of goods from one member State to other member States, according to the development of EU case law. The interpretation of article 35 has changed accordingly. Part 5th: mainly analyzes the exclusion application of the EU principle of free movement of goods. The reasons for these exclusions can help member States to reasonably circumvent the application of articles 34 and 35 of the EU operational Treaty. Under article 36 of the Treaty and the mandatory requirements, In order to legally exclude the application of the EU principle of free movement of goods. Part 6th: the enlightenment of the principle of free flow of goods from the EU to China-ASEAN Free Trade area. Through the study of the principle of free movement of goods in the EU, This paper further discusses how the newly established China-ASEAN Free Trade area draws lessons from the successful experience of the European Union and puts forward some suggestions on this issue.
