WTO体系下我国金融风险防范法律制度研究

【摘要】：WTO在全球化过程中具有里程碑意义,但是全球化却增加了各成员国金融部门的风险,也增加了金融风险转化成金融危机的机率。WTO自1995年成立以来,世界经历了多次金融危机,破坏性越来越大,2008年美国金融海啸的暴发使WTO体系下的金融体系经历着前所未有的挑战。中国加入WTO体系已有十年的时间,中国金融部门也在逐步完成国际化过程,同样也必然面临金融风险对中国经济发展的严重威胁和破坏。作为最大和人口最多的发展中国家,中国对于WTO体系下金融风险防范法律制度的研究处于初级的起步阶段,需要众多学者不断的探索与创新。笔者作为探索者之一,从中国市场经济的各个经济部门与金融的内在的必然联系入手,分析它们之间的相互关系,从不同经济部门的法律制度来研究中国金融风险防范问题,试图突破众多学者将研究的注意力集中在金融监管法律领域的局限,从中国市场经济的宏观立场探索WTO体系下中国金融风险防范法律制度研究的新方法。本文首先研究和分析我国在WTO体系下面临的种种金融风险,对比1997年东亚金融危机、美国金融海啸以及冰岛、希腊等国的主权债务危机中引起危机的主要原因(国外资本的恶意攻击、国内政局不稳定、经济结构不平衡、放松金融监管等),论述中国应该从中吸取马来西亚政局不稳、韩国、冰岛和希腊经济结构不平衡、印尼放弃金融监管的教训,借鉴美国从多个经济领域立法防范金融风险的成功经验,并结合中国具体国情论述中国金融风险防范法律制度建设。最后,本文试着从中国市场经济的整体着眼,主要是从经济结构平衡、坚持独立的持续发展原则、国家经济安全以及金融自身的完善等方面为我国金融管理提供一些法律上的意见和建议,以期进一步完善中国在WTO体系下金融风险防范法律制度,并希望可以通过自己的努力为此作出力所能及的事情。
[Abstract]:WTO is a milestone in the process of globalization, but globalization has increased the risk of the financial sector in all member countries, and also increased the probability of the financial risk turning into a financial crisis. Since its establishment in 1995, the world has experienced many financial crises. The US financial tsunami in 2008 made the financial system under the WTO system experience unprecedented challenges. Ten years after China joined the WTO system, the Chinese financial sector is also gradually completing the process of internationalization. It is also bound to face financial risks to China's economic development and serious threats and damage. As the largest and most populous developing country, China's research on the legal system of financial risk prevention under the WTO system is in its initial stage, which requires many scholars to explore and innovate continuously. Starting with the inevitable relationship between the various economic sectors and finance in China's market economy, this paper analyzes the mutual relations between them, and studies the prevention of financial risks in China from the legal systems of different economic sectors. This paper attempts to break through the limitations of many scholars' researches on the legal field of financial supervision and explore a new method for the study of China's financial risk prevention legal system under the WTO system from the macroscopic standpoint of Chinese market economy. This paper first studies and analyzes the financial risks that China faces under the WTO system, and compares the East Asian financial crisis in 1997, the American financial tsunami and Iceland. The main causes of the crisis in the sovereign debt crisis of Greece and other countries (malicious attacks by foreign capital, instability of domestic political situation, imbalance of economic structure, relaxation of financial supervision, etc.) discuss that China should draw lessons from Malaysia's political instability. The economic structure of South Korea, Iceland and Greece is unbalanced. Indonesia has abandoned the lessons of financial regulation and learned from the successful experience of the United States in legislating against financial risks in various economic fields. Finally, this article tries to focus on the overall view of China's market economy, mainly from the economic structure balance, adhere to the principle of independent sustainable development. The national economic security and the perfection of the finance itself provide some legal opinions and suggestions for China's financial management, with a view to further improving the legal system of financial risk prevention under the WTO system. And hope that through their own efforts to do what they can.
