海外流失文物追索法律问题研究

【摘要】：清末民国以来,我国文物因战争原因被大量掠夺,或因其他原因流失海外。追索海外流失文物一直是我国政府关注的问题,并积极通过各种途径进行追索。但因主要追索途径都有其自身的局限性,我国追索流失文物收效甚微。圆明园兽首拍卖事件后,国内法律人士逐渐侧重于研究通过诉讼途径对我国流失文物进行追索,其中以刘洋为代表的中国律师在洛阳市中级人民法院提起追索海外流失文物的侵权诉讼,成为通过国内司法途径对海外流失文物进行追索的先例。但因诉讼途径之前并未被成系统地研究分析,缺乏理论和实践指导,我国律师提起的追索文物诉讼并未获得成功。本文拟通过对海外文物追索法律问题研究,分析海外流失文物追索诉中存在的法律障碍,以期寻求对海外流失文物追索的有效途径。
[Abstract]:Since the end of the Qing Dynasty and the Republic of China, cultural relics in our country have been plundered in large numbers for war reasons, or have been lost overseas for other reasons. And actively pursue it through various channels. However, because the main recourse channels have their own limitations, the recovery of lost cultural relics in our country has had little effect. After the auction of Old Summer Palace's animal head, Domestic legal personages have gradually focused on the study of pursuing lost cultural relics in our country through litigation channels. Among them, Chinese lawyers, represented by Liu Yang, filed an infringement lawsuit in Luoyang Intermediate people's Court to pursue the lost cultural relics overseas. It has become a precedent for the recovery of cultural relics lost abroad through domestic judicial channels. However, because the legal channels were not systematically studied and analyzed before, there is a lack of theoretical and practical guidance. The litigation brought by our lawyers for cultural relics has not been successful. This paper intends to analyze the legal obstacles in the recovery of cultural relics lost abroad through the study of the legal problems in the recourse of overseas cultural relics. In order to seek an effective way to recover the lost cultural relics overseas.
