中外合作办学法律问题研究

【摘要】:从1986年9月我国第一家中外合作办学机构南京大学—约翰·霍普金斯大学中美文化研究中心成立至今,我国中外合作办学至今大致经历了早期探索时期、快速兴起时期之后一直走到了今天的成熟发展时期,这一时期我国中外合作办学呈现出欣欣向荣的喜人局面,数量剧增、范围扩大、合作项目更趋多元化等特点。2001年12月11日,中国正式加入了WTO并对教育服务贸易做出了具体承诺,这标志着我国中外合作办学法律规范开始融入世界法律体系。 《中外合作办学条例》及其实施办法的颁布实施标志着中外合作办学正式走上了法治化和规范化的轨道。但是由于我国教育服务产业起步较晚、结构不合理、教育水平较低等原因,在合作办学过程中暴露出政策法规风险、学位认证风险、纠纷及诉讼风险和办学质量监管不到位等较为严重的法律风险。如何改变我国中外合作办学立法层次较低且空白较多、现有的教育公益性原则与WTO/GATS原则相悖、合作办学方利益保护不足、甚至违反国际法规则等现状,有效预防上述法律风险的产生成为迫在眉睫的任务。 本文在WTO/GATS框架下,结合国际法律原则和规则,针对合作办学过程中出现政策法规风险、学位认证风险、纠纷及诉讼风险和办学质量监管不到位等较为严重的法律风险,建设性提出修改相关教育法律法规的“非营利性”内容、完善中外合作办学纠纷解决机制、强化中外合作办学机构教育质量的法律管理、完善中外合作办学国家之间的学历互认制度等预防和化解合作办学各种法律风险的措施,以求我国中外合作办学的稳步健康发展。
[Abstract]:From September 1986 China's first Sino foreign cooperative education institution of Nanjing University - Johns Hopkins University Center for Chinese and American studies since its establishment, Sino foreign cooperative education our country has experienced the early exploration period, after the rapid rise period has reached the mature period of development today, this period of Sino foreign cooperation in running schools in China showing a gratifying situation, the increasing number of thriving, to expand the scope of cooperation projects, more diversified characteristics such as.2001 in December 11th, Chinese joined WTO and the education service trade has made specific commitments, marking the school standard law of Chinese foreign cooperation began to integrate into the world legal system.

But because the education service industry in China started late, unreasonable structure, low level of education, exposed the risk of policies and regulations in the cooperation in the process of education, degree certificate risk. Disputes and litigation risk and the quality of supervision is not in place and other more serious legal risks. How to change the foreign schools and the low level of legislation blank more cooperation in our country, the education public welfare principle and the WTO/GATS principle existing contrary to the lack of cooperation to protect the interests of parties, even in violation of the rules of international law and the status quo, which effectively prevent the law the risk has become an imminent task.
In this paper, under the framework of WTO/GATS, combined with the principles and rules of international law, policies and regulations for risk of cooperation in the process of education, degree certificate risk, disputes and litigation risk and the quality of supervision is not in place and other more serious legal risks, the construction of proposed to amend the relevant education laws and regulations of the "non-profit" content, improve the Sino foreign cooperative education disputes settlement mechanism, strengthen legal education quality management of Chinese foreign cooperatively run schools, measures to improve the system to prevent and resolve the recognition degree between the countries in the cooperation of Sino foreign cooperation in running schools all kinds of legal risks, to the healthy and steady development of Sino foreign cooperation in running schools in China.
